So I got arrested in my own house for a possible DUI. I did not get pulled over nor did the police officer witness me operating my vehicle. The only case that I could possibly see is careless driving for running over a neighbors lawn. The cops were called for another reason the neighbor came to my house with a gun and my father pulled out his took his gun and called the cops. I was arrested for DUI but the officer couldn't prove that I was intoxicated while operating a motor vehicle and didn't even read me my rights.Do you think I have a case?

Can I be evicted from my landlord for this noise disturbance?

 

I had a party at my house on saturday night. During the party, a dozen individuals showed up and started to cause trouble. We told them to leave and they refused to. Once we got them outside, they started to become violent and started to throw beer bottles towards my vehicles and my guests. A fight ensued because my friends car was hit. I called the police and the police arrived 15 minutes later. I told the police what happened and my guests gave descriptions of the vehicles and suspects. One car was pulled over 3 miles away and they were arrested for DUI and marijuana possession and reckless driving. This was at 2am and my guests were staying at my house because I don't allow people to drink and drive at my house. The police gave me a citation(no fine) for the party and said its still my fault cause its my party. Everything was under control until these fools came. So If i have another party within 90 days i get a 1000 fine. But on the ticket they misspelled the street name and put th
On the citation they misspelled my address and they put my roommates name instead of the landlords name(not on there) and their phone number. So I was wondering if there is a strong chance that the police can found out who my landlord is at our house(not a apartment) and if the HOA can find out.

Like I said, the police report says that me and my guests did not cause the commotion and the suspects were arrested.
I had complete control over who came to the party. I am not sure who invited these people over. When we told them to leave because it was late, they started to get violent. Thats when I did my civic duty to notify the police. Because of their poor response time, a fight ensued. I was offered a citation(no fine) just a warning because of it. They said im still guilty because it was my party. I didn't wanna argue with the police officer because i wasn't being fined. and it was late. I haven't heard from my landlord about it. Plus also when the police arrived and the individuals dispursed I offered the police officers some water and was upfront and honest about the whole situation. This is why I believe they were cool with me.

On The ticket, my rights are on the back and it says I can argue the ticket if I called the police in order for them to keep the peace in the neighborhood

A friend of mine was pulled over - she hadn't broken any traffic laws or hit anything / anybody while driving. She was stopped because a police officer did a check on her license # and found that her tags had expired or some such. The officer smelled alcohol on her breath and got her on a DUI. It's been three years. Is she free? This happened in California

I got a dui but it will not go down as a conviction can i still be hired as a police officer?

 

I got the dui and was taken in but not officially arrested and i did diversion so the dui will not go down as a conviction and i got a reckless driving but that will be dropped because i did community service and i am an college right now and when it happened to be a police officer. It happened over a year ago what are my chances of working in a police department in oregon

Is a marijuana urine sample enough to convict me of an Oregon DUI?

 

I'm 16 years old and am being charged with three felony counts of reckless endangerment(one for each minor in the car), one count of reckless driving, and one of a suspected marijuana-induced DUI. I do not own a license or a permit.

I was driving my girlfriend and two friends home from a party, because I was afraid otherwise they would have driven home with a drunk driver and possibly lost their lives. I didn't want that to happen. Anyway, I had smoked marijuana around 10PM and was on the road at around 1:30AM, and was (by my perception) completely sober.

I'm not an experienced driver by any means and was driving at night on a windy road with faint lines. I admit I was weaving a bit, but my girlfriend's car has horrible handling (extremely loose) and always weaves to the right for no apparent reason. Me, not being an experienced driver, was trying to constantly correcting this. I was also speeding up and slowing down (pressing down on the gas pedal and then releasing it to coast). There was 9-1-1 call from a car following us that suspected me to be driving under the influence.

I was pulled over by a police officer minutes later. I was arrested on suspicion of driving under the influence of marijuana. I failed two sobriety tests(the two leg ones), because because my muscles were so damn sore from playing basketball. Funny thing is I passed The Horizontal Gaze Nystagmus Test. According to the officer (who apparently is a Drug Evaluator Expert, so he can testify in court as an expert) my pupils were extremely dilated.

When I was brought into the station for booking, I took a breathalyzer with 0.00%BAC. I also took a urine test.

Now here are my questions:

What are my options?

If ANY amount of marijuana shows up on the urine test, is that enough for a DUI conviction?

What is the amount of marijuana that is needed to be found for a conviction?

I was in a accident on december 7th 2007. I found out that my licenses was suspended that night for letting my insurance lapse and not having a sr22 @the time. when the police showed up i was stuck in my car and the cop pulled me out of the passenger side door banging my head on the door. he put on the accident report he arrested me because a beer bottle fell out of the car but on my ticket i wasnt charged with a open containerwhy not? i also was not read my rights and i had to go to a different station for the breath test and i wasnt told that i did have to blow but i will lose my liscense for a year is this called a illegal arrest? the cop said that he was sleeping in a private lot on his shift, he also said that there was now evidence of me having slurred speech bloodshot eyes or lack of coordination. i also was not given a field sobriety test. can someone help me to understand this as soon as possible????
I have a lawyer but we keep getting a continuence because i had to blow 3 times and he wants all the reports of why i had to blow 3 times. he thinks the prosicuter has a week case. i just need to understand all this paper work he gave me and i have never been in trouble with the law before and i am afraid to ask him questions cause i feel stupid.. can a police officer please answer this for me???
i did not have slurred speech. i got hit with the air bag in the eye. they just threw me inthe police car and took me to the other station for the test. i wasnt drinking in my car and i never do. i aways were my seat belt and they said i wasnt. on the third test i blew a .135 they never told me what i blew the other two times. my lawyer said it was coherced.
i live in cleveland ohio. i hardly ever drink at all and i have never been in trouble with the law before in my 39 years of life. i have had no points on my licenses since i have had it.
it was a ittle fender bender i got into and i am not or have i ever been on probation at all.

If one has a bench warrant in arizona for failure to appear on a dui charge, will a police officer in Illinois?

California DUI question...?
I had my first DUI yesterday unfortunately but the circumstances were bizzare and I was wondering if it would be worth it to fight..

Last night I get home and park a block from my house after going out. After getting to my door I realize I forgot something in the car. When I get back to the car a police officer is in front of the car and asks me if its mine. I say yes. He says "We had reports of this car swerving while driving" mind you he never saw me in the car at all, this is from a call in. He proceeds to give me a field sobriety test then takes me to jail and I blow a .13 - Is it worth it to fight?

What do you think about DUI checkpoints?

 

I was in one, and was asked how much I had to drink, and I very politely answered 'zero' (It was the truth, and I was a little nervous)

I was clean cut, in town on business

deputy got all smart aleckly and cocky 'ZEE-ROW, HUH?'

Seemed to really be on a power trip - really seemed to enjoy throwing his weight around

Is this acceptable behavior for cops?
Personally, i do NOT support giving up 4th amendment rights, IF the police do not use that power respectfully
I still dont think the attitude was justfied, they stuck one of those flashlights near my face, and i didnt avoid breathing on it.

well, I wasnt one of them - does that give him the right to take that frustration out on me? I get frustrated all the time as a consultant, and I can NEVER talk with people like that. But then, I dont carry a gun and a badge

that's NOT true at a checkpoint! when you pull over at a checkpoint you have NOT done anything wrong!
Oh, and the 4th amendment issue? MY state's supreeme court says it is a violation of 4th amendment right, they are illegal in my state. And we are in the 5 safest alcohol accident rate states in the country (and we're not bible belt or mormon)

By the three counts of reckless endangerment, it's one felony for each minor in the vehicle. Which there were three.
