I'm 20 yrs old, I got my first DUI like a few weeks ago..I was driving while high they say..I wasn't drunk at all but high so they say. When I took a breathalyzer it came back 0% Should this look better for me? They said they found a little under a gram of marijuana in my car..I was ticketed for missing headlight (didn't even know, was the real reason i got pulled over, failure to yield, no insurance, no seat belt..all BS because they never asked for my insurance..there were NO cars on the street and our seat belts were totally on..Judge said he they wouldn't appoint me a public defender because I wouldn't be at risk of serving any jail time anyway..and he gave me time to find a lawyer or to defend myself..I said i would get a lawyer but I'm just wondering how much that will cost my parents..Ive heard crazy stuff like ,000..Sounds utterly insane! I wasn't even drunk...I live in Memphis, tn..Can anybody give me any ideas of how much this will cost? Because I mean if it costs even ,000 I'm just going to defend myself because that's just ridiculous..I doubt that much worse would happen if i DID defend myself..Someone told me at the level court or something it wont go on my record or anything like that anyway so there's no way in hell i would give an attorney that much freaking money..Can someone help me out here

Driving while drunk is a seriously bad maneuver for a host of reasons. You will learn as much if you are involved in an accident while driving drunk. Such an accident will raise the issue of criminal versus civil legal issues you'll have to deal with in court.

There is a certain fear factor used to deter drunk driving. The fear is created by the threat of harsh penalties. The penalties range from jail time to massive fines. These penalties are all related to criminal legal actions. What is not often discussed is the fact civil actions can arise from drunk driving situations. Let's take a look at an example.

You go down to the local watering spot to watch the big game. The game takes three hours and you consume a number of adult beverages during this period. In fact, you are legally drunk. You hop in the car to drive home. You fall asleep at the wheel and run into someone else. They are taken away to the hospital and you are taken away to jail. You later learn they suffered whiplash, but are otherwise okay. So, what now?

The first thing that is going to happen is pretty much what you would expect. You are going to be charged with a DUI and a host of other charges related to it. Depending on the state, you may well be charged with a Felony DUI since an accident occurred. You'll need to hire an attorney, which is going to cost a pretty penny. You are probably going to be convicted or forced to take a plea bargain deal. This means facing everything from large fines to jail time. Basically, it is going to be a nightmare scenario, but there is more to consider.

The driver of the car you hit is going to be very unhappy as you might imagine. That person is going to sue you in civil court. Your car insurance will provide for your attorney and some money towards damages, but you are going to be responsible for the rest of any judgment. With massive car damage and physical injuries, the judgment is going to be in the tens or hundreds of thousands of dollars. This is on top of what you already spent in the criminal action.

The total cost of a DUI in both criminal and civil actions will wipe out most people from a financial perspective. Filing bankruptcy is a very common step following the cases. The next time you consume adult beverages, just spend the money on a cab. It simply makes financial sense.

DUI Marijuana charge?

 

Ok first of all I was not under the influence when I got pulled over and had 0.00 alcohol in my system. Due top a technicality my lawyer found I am gonna have the charge completely wiped from my record. I am curious as to if I can sue the cop for a illegal search and seizure. When he pulled me over he opened the wood said something about my tags then asked if I was smoking pot. Told him I did 4 hours ago 1 hour before I got in the car. He told me Can I please search your vehicle because I am going to anyways. I was wondering if I can sue him cause all my friend a few law people I know told me that is a illegal search and seizure because of how he worded the question. I even passed the sobriety test all of them and then he told me I was going to jail because my eyes looked messed up. I really want to know if I have a case I feel the whole pullover was a joke and it shouldn't cause me money cause some cop was a dick. AKA my license plate tags were fine that's why my lawyer said the whole case will get thrown out I just wanna know if I can press charges against the cop...I rather him pay for my lawyer than me.

what do you think about the asap DUI, law.?

 

the asap programs are all privetly ownd, and some one is makeing a lot of money, why do the courts let them and the DMV have this much power. 20 k, for a frist timer, this is not right, if you blow a 0.5 they can still get you.

What are the chances of doing time in Arizona with a first offense on a DUI and no priors of any sort?

 

My daughter got a DUI in January and since we cant afford an attorney I need to know what shes looking at if convicted or how should she plea. Shes never been in any sort of trouble and was under the influence of marijuana when she got stopped. I live in Texas and cant do much from here except from my computer. Can anyone give me some guidance or someone I can call that can help? I dont have the money for an attorney and need to work fast because she didnt want to worry me and just told me last nite and her court is in 1 week on 4/29.

I just wanted to get other peoples opinions. Do you feel that the DUI laws have gone too far? What can the public do to stop it. I know if someone is drunk they need to go to jail. Don't you think that putting everyone in jail for having a couple of drinks is too much? In this economy, it's only hurting the working class, tax paying citizens. I feel that it's just a big business so that MADD can make money. I never got a DUI but a couple of friends of mine have. One only had one drink and they took him to jail even though he blew under. I mean does everyone have to just stay home now? How can the community fight back. It doesn't matter if someone is at .05 or .08 or .02 what matters is if they are "driving DRUNK" which would be over all of those. MADD wants to change the limit to .05 for what? they can take you to jail for .01 now if the cop wants. What does it matter?

I need help! Any info on DUI with child endangerment charges!?

 

My husband was just taken to jail. He as speeding, so he was pulled over by the state police. He was also not wearing a seat belt. They are going to charge him with child abuse. What can i expect him to get for fines and what will he need to do. This is his frist offense of chils abuse, but his 2nd or 3rd DUI.Should I spend the money on a lawyer? He was told he has been issued a warrent for his arrest. So if I bail him out will they turn around and pick him up the same day? What would that cost me to get him out of jail then? the cops let him call me to pick up my child and my car.Pleas help any info will be greatly appreciated. Thanks

What happens to you when you get your 3rd dui?

 

My brother in law is not too bright and he has 3 DUI's and he went to court and they wanted to take him to jail for 10 months... So he posted bail... No what? He just gets away with it? He doesn't have to go to jail?
and if he hires the BEST attorney that money can buy will he do and time in jail...
