I had a dui on November 20th of last year in New Jersey. It was my first offense and my last. I will be getting my license back soon and will be looking for auto insurance. Can anyone give me some recomendations. I have no points on my license.

Marijuana Misdemeanor, California?

 

I am 19. My friend was driving me home from a party in his car when he got a dui. They arrested him, then told me to step out of the car, put my hands on the hood. Then asked me my name and if I had anything illegal on me. I gave my name, but before I could continue to respond the officer felt me up and took everything out of my pockets. He didn't ask to search me, have a warrant, or even TELL me I was going to be searched. They found my pipe and weed, threw the pipe away for me, and put me in cuffs and took me downtown where I sat in handcuffs for a few hours. They let me go and gave me a court date for "marijuana possession less than one ounce".

Given the story above, what can I do to fight this charge? It is my first offense against the law of any kind. Can I get out of it because they didn't ask to search me? DO they have the right to search any passengers when busting the driver of the vehicle for a dui?

I heard a rumor that if I got a medicinal marijuana card before my trial that they would let me off, but I can not decide if I should do that or not because I am wondering if it matters that I was arrested for marijuana BEFORE I get a card so I would still end up facing the charge?

IF I DO have to take this charge under the chin, what is the best that I could hope for? Take a rehab class and have the charge taken off my record? I really concerned for my record. Thanks in advance

during a dui arrest, how common is it for the officer to lie and say you refused a chemical test?

 

This happened to someone very close to me. It was a first offense, and the arresting officer lied about him refusing the chemical test. Now this individual has a suspended DL for one year, even though the court dropped the charges.
I think it's wrong that these individuals have that kind of power.
Julius, really , it's not nessecary to use this site as a platform for rudeness. Just a simple, decent answer that denotes some vague intelligence would be nice.
Actually, he was convicted of the dui but the charges for refusal of a chemical test were dropped. The truth is, in California, the DMV can still do what it sees fit with your dl.

Is it possible to have a DUI/DUI Drugs charge dropped?

 

I currently have a DUI and DUI drugs charge against me. It is my first offense and I have a clean record. The DUI is going to be fought as I had a fever and suffered an Asthma attack during the traffic stop. I was denied my asthma inhaler which effected my oxygen levels and had an anxiety attack on top of that. I am a regular marijuana user and had a blood test taken. The results will obviously show marijuana use within the 24 hours of arrest.

MY questions are: Can the charges be dropped or reduced with a clean record? Will my license be taken away and for how long. Is there any way to dispute the license suspension? Will I be able to receive lenience as I am a full time college student and work full time? Any additional information on DUI/DUI drugs charges in Phoenix would be helpful.

I got a dui in 01 i went deferred only because driving at that time was my occupation,in 06 i received another since it was deferred the second charge was tried as a 2nd and i received 90 days and lost my license for 2 years,now 7 years later my first dui is being tried as my 2nd 2nd and 900 day license suspencion 55 days in jail and 90 days home confinement They are citing Quesada vs weinbrenner
I already have a public defender who insisted that this would be tried as a first offense since it did occur 5 yrs before the second. i now have two months.I sold my house moving to texas so i quit my job im stuck

Since you got yourself into this mess, you will need to get yourself out. This entire process can be very stressful at times, but if you really want to get the charges dropped then you have no choice and you have to keep moving forward. Just remember, next time, do not drive under the influence.

How do I get affordable insurance after dui non-conviction?

 

State farm is canceling my auto insurance after a company called ChoicePoint inc. reported info. from the DMV about reinstatement of license, Chemical test modification and Chemical test revocation. I was arrested for a first offense and plea bargained to jump though all the hoops, pay all fines in order for it not to result in a conviction. Are there any insurance companies out there that do not purchase info. from ChoicePoint?
