the person was driving and then saw a dui checkpoint coming up. he then turned onto a street about 2-300 feet away from the checkpoint and made another right turn immediately. the line of sight was clearly broken between him and any officers and so he exited his car and started to walk away. when he got about 15-20 feet away from his car an officer turned the corner on a motorcycle and approached him. he admitted to having a few drinks but does not think that he admitted to driving under the influence, if he did admit to driving it was under duress from the officers (3). he then was submitted to alcohol tests and arrested for a dui. Does this person have a chance in court arguing that he was not driving the car? or maybe that someone in the same type of car drove away and this person was just in the wrong place at the wrong time? also if the officers demeanor was at all inappropriate does it matter in court? thank you for your time

Here is what happened... The night of my girlfriends rehearsal dinner for her wedding we all went out to a bar after... I drove my car sober and one of the other bridesmaid's boyfriends said he would drive my car home so I can have a few drinks (I DO NOT DRINK AND DRIVE). Well we left the bar and they were fighting the car. I have a really small Audi TT coupe that barely has a back seat so it is not comfortable to sit in back there. Anyway he pulled the car over and got out and jumped in the car with his buddies and took off. I knew that we needed to find a ride and I knew that if the cops came that I needed to make sure the keys were in the trunk so we put them in the trunk and started calling to find a ride. In the meantime the worst possible thing yes the cops pulled up. Apparently where we pulled over it was no parking so of course now I am sittin gin the driver's seat and they ask me to get out and so on and so forth they are trying to charge me with a DUI. I even explained to the officer the situation and that the keys were in the trunk. I guess due to an unpaid fix it ticket I had a suspended license. I never changed my address a year prior to moving so I never got the notice so for that I was at fault. They would not let us call for a ride and the officer told me if I didn't do a breathalyzer then he would take both of us to jail. I did and it didn't read my blow so he yelled at me and told me we were going to jail. This to me was extremely unfair. They held us for over 18 hours because they said we were not cooporating when in fact we were very respectable but we did keep asking to let us call a ride and they took away our phones. ( I now know this is illegal). So I am now in living in Colorado and I just got a new job and my court date is coming up in December. I cannot afford a plane ticket to California just to plead not guilty.
Can anyone offer any advice on what I can do? I know for a fact that way they went about the arrest was completely illegal but I don't really know what to do at this point cause I have never been in this position.

I hit a bench on my way home from dinner and was arrested for a DUI at my house after being home for about 15 minutes. I told the officer I had consumed two drinks upon returning home. I did take a breath test in the car and the officer would not show me the results. He just said I was .08 (.08 is the low end for being under the influence in Michigan) I asked several times to see the test results but he would not show them to me. At the hospital I took another blood test and it was .069 They took me to jail and I had to bond out. I am feeling like I am really getting hosed here. Was this arrrest even legal? Can a DUI arrests stand up under these circumstances? I live in a very small town.

It was my 1st time and I won't get convicted. I am worried that it will affect future job employment as I am in school for children psychology. I just had 2 drinks that night was over the legal limit when I got pulled over. And I feel devastated and awful now. Please help!!!

I wonder how many people realize that two drinks at the company Christmas party can get you thrown in jail. You don't even have to fail a field sobriety test or breathalyzer test any more; it’s all up to the officer's discretion.
If people who have had two drinks are a hazzard to the road then so are people who are sleep deprived and the elderly. They should also be arrested and have their liscense revoked.

What is the point of making DUI a crime? There are laws against hitting people, swerving, speeding etc. already. All that DUI laws do is arrest people for a potential crime that could be commited. There are thousands of people every year who have there finances and careers ruined. When all they did was have 2 beers and decided to go home. Not everyone who drinks and drives is drunk or out of control. Should all gun owners be charged with a crime because they own a gun? It's the same idea. Shouldn't you actually have to do something wrong to get arrested? If you speed while drunk then you get a speeding ticket, if you hit someone then you get a murder charge. But why punish those who haven't broken any other law?
Note: I don't care about your sob story of how someone was killed by a drunk driver. The driver should have been charged with murder. I am talking about all the people who didn't do anything eles wrong.
all of these personal attacks just show your ignorance and inablitiy to think critically. None of the analogies have been correct. if one robs a bank they have commited a crime they have stolen. Drinking and driving is a victimless crime, if you hit someone then you have committed a crime.

i got arrested and charged with a dui and a ticket failure to use due care.
i live in fort lauderdale florida and was wondering if anyone knew of a good attorney.
I did NOT take the sobriety test. I told the officer I would not do anything without my lawyer.
I dont know if that was a smart move or not, but i know I wouldn't of passed the test.
What are my options looking like?

the accidet was i went over the curb and across a few lanes on the other side of the road. the cops gave me a road test which i didnt pass too well, didnt fall or anything. i told the police i did have a few drinks. someone saw the me go across the lanes, it wasnt that i was pulled over randomly or anything like that. and when the police showed up i was even driving i was just sitting in the parking spaces i stopped in.

for those who think of me as a bad person, i do understand and respect that. i did make a mistake and yes im thankful to god that nobody got hurt and myself second. but i just think about who i could of hurt, or hit another car. it was 2 in the a.m and i was coming home from the bar. did make a mistak i do admit. but im hoping for some leinency, because i am human. i do make mistakes, but i do learn from them. i am a very respectful person, i work hard and just was out on a tuesday night because i cant go out any other nightreally because of work and such other obligations. im not asking forcriticism i am a very hard person on myself and expect great things from me. this is just abump in the road and i do apologize to everyone once again.
