How do I get my license unrestricted after a California DUI?

Okay, the title of this question leaves out some details I will fill in here. Here is the situation... I received a DUI in Southern California...

Here is the situation...

I received a DUI in Southern California (Santa Barbara) in late 2007. I was living at home (I am from the area) for a while after having lived in New York City for over 10 years. During my time in NYC I made the huge mistake (as I have since found out) of not switching over my license to NY State (apparently, my lawyer informed me that this not only would have allowed me to keep my license in hand but also that, because I could still prove NY residency at the time, I wouldn't have had to attend those idiotic DUI classes they punish you with).

Anyhow, I spent my year in California and made it through the classes and have now just paid off the fine. This is where my problem begins...

I moved back to NYC over a year ago. I am now wishing to make my license a NY State license. However, NY law does now allow you to transfer a license from another state that possesses any sort of restriction. Though I have paid off the fine and basically fulfilled all of the responsibilities that the Court ordered, I am still under the impression that the DMV still requires me to have an SR-22 (proof of $ responsibility), for which I will have to purchase insurance. The problem is, I never needed insurance before. I have never owned a car and before I left home I was covered under my parent's policy. I DID purchase insurance while in California in order to have the SR-22 on file with DMV, but upon moving I let my insurance expire as I could not afford the payments and had no need to drive (a big plus about NYC).

If the DMV rule is what I understand it to be, I'm under the impression that I must have an SR-22 on file (in other words, purchase insurance) even though I have fulfilled my court-ordered punishment (and yes, I do know that they are separate entities with separate rules). And since I need the SR-22 on file to get my license unrestricted in order to transfer my license to NY State, I'm forced to buy insurance that I don't need in order to do it.

If you're wondering why I don't need the insurance...again, I live in NYC, own no car (with no intention of ever having one) and do all of my driving in rentals when on the road for work or vacation so I'm covered by the rental agencies. I REALLY don't want to spend money I don't have on something I don't need just to do this.

Can anyone offer advice on working this problem???? Any and all help is appreciated.

I got a DUI in California 10 years ago on spring break, just now my home state put a block on my License …?

 

I already did my classes in Ohio and paid fines for it to California. I reissued my License 3 other times and asked my home DMV what had happened and said that I had no block on it and it seemed like it cleared up. It happend when I was a young niave college kid. Now I am a college grad, engaged and planning to have a kid. Im so afraid that through some loop hole or paperwork, identity theft that somehow in never got cleared? Anyone had something similar happen?

What kind of sentencing should I expect?

 

I am going to turn myself in today for 3 misdemeanor charges for possession of marijuana and a DUI in which the DMV issued an order of reinstatement for my license. I want to know if anyone knows what I should be expecting thanks!

DUI Arrest: Do you need to request a DMV hearing if your BAC test results were below .08 in California?

 

I was arrested recently for suspicion of a DUI - and charged with California VC 23152 A. I didn't commit any traffic violations, the cop pulled me over on the freeway because he claims I weaved in my lane. I don't believe I was impaired or driving under the influence. My breathalyzer test results showed a BAC of .07 so technically I was under the legal limit. I spent the night in jail but did not have to hand over my license to the officer and was able to get my car back the next day. I think that when I finally go to court they will reduce this to a lesser charge since I didn't get in an accident and have no prior offenses.

If I was charged with a 23152 B, I know the DMV would automatically suspend my license but I wasn't charged with that. That being said, do I need to request a hearing from the DMV?

okay lets say you get pulled over for a possible dui and you ask to go to the hospital to get a blood test then you get a ticket (never go to jail) then the dmv calls you and tells you your licence is going to be suspended but you havnt been convicted of anything by any court. does the right to a quick and speedy trial apply? so basically if you dont get a trial set in 45 days does that mean that your chances of a dismissal are good... thanks ohh and i dont drink (thank God) so save the dont drink and drive comments

Second... I signed over the title but he never took it over to the DMV is it to late for him to switch it over? Or do I have to go take it out myself

I'm on informal probation (no probation officer) for an alcohol DUI. I have less than a year remaining. I was just pulled over and the officer found that I had a "suspended license." The reason for this was that I changed insurances and my new insurance agency hadn't informed the DMV yet. This caused it to come up suspended because in order to drive in California, you must be insured. Also, I got a ticket for possession of marijuana that was an eighth or less. I have a court date next month. I'd love to know what to do in the mean time and what I could expect in court. I've already cleared up the insurance stuff...

My dui conviction was dropped is it still on my record?

 

They said i just had to go to the dmv to get my license back. And if i get a second one will that count as a first or a second and get a felony?
