			<content:encoded><![CDATA[<p>OK, so someone lives a block away from their local bar.  On the way from work, this person slams six beers in 15 minutes and gets in his car to go directly home. He is not drunk, as there is not enough time for enough alcohol to absorb in his system.</p>
<p>He should make it home in 30 seconds, but gets pulled over because a cop was staking the tavern out.</p>
<p>The driver refuses the field sobriety test (which is only an option) because of a handicap and is arrested for DUI.  By the time he's down in the station giving a breath test, he is now drunk.</p>
<p>Are DUI laws really fair when you can get charged for DUI when you were not impaired while you were driving?<br />

I occasionally use her car every now and then to run some minor errands, but I am very cautious as it obviously has an expired tag and no insurance. I just wanted to know what would happen if i were to get stopped by a cop driving her car? What's the worst that could happen?</p>

Does the punishment matter for the state (CA), or the circumstances... (he was in a drive thru and a cop went up to his window) or does anyone know where I can find out the info on punishment?  Asking because my guy really wants his brother to move to where we live and get out of that black hole of destruction that is our home town... lol.  Anyways, I hope he learned his lesson, I'm thinking he might have to sale his 1999 Toyota Tacoma to pay the fine, which I thought was a universal ,000.00 for a seconf offense.  BUT I would appreciate any info.</p>

I'm under my parents insurance policy and i didnt tell them about the drinking part thinking i can i hide it from them. When filing for the SR22 will my parents find out about it. He said they never mentioned a blood test.  Never asked so he never refused.  The first cop's breathalyzer wasn't working so he called back up so he could use the other officers.  He said that the police was very nice.  He was pulled over for going 58 in a 45.  There was no accident or anything.  The officer apparently thought he was showing signs of drinking so he did the sobriety tests.</p>

Due top a technicality my lawyer found I am gonna have the charge completely wiped from my record.  I am curious as to if I can sue the cop for a illegal search and seizure.  When he pulled me over he opened the wood said something about my tags then asked if I was smoking pot.  Told him I did 4 hours ago 1 hour before I got in the car.  He told me Can I please search your vehicle because I am going to anyways.  I was wondering if I can sue him cause all my friend a few law people I know told me that is a illegal search and seizure because of how he worded the question.  I even passed the sobriety test all of them and then he told me I was going to jail because my eyes looked messed up.  I really want to know if I have a case I feel the whole pullover was a joke and it shouldn't cause me money cause some cop was a dick.  AKA my license plate tags were fine that's why my lawyer said the whole case will get thrown out I just wanna know if I can press charges against the cop...I rather him pay for my lawyer than me.</p>
