for dui. Passenger then allows search and the cop finds marijuana in the passengers bag.. the driver is not charged for dui. Is the search then legal? is a Coersed search valid?

Ok first of all I was not under the influence when I got pulled over and had 0.00 alcohol in my system. Due top a technicality my lawyer found I am gonna have the charge completely wiped from my record. I am curious as to if I can sue the cop for a illegal search and seizure. When he pulled me over he opened the wood said something about my tags then asked if I was smoking pot. Told him I did 4 hours ago 1 hour before I got in the car. He told me Can I please search your vehicle because I am going to anyways. I was wondering if I can sue him cause all my friend a few law people I know told me that is a illegal search and seizure because of how he worded the question. I even passed the sobriety test all of them and then he told me I was going to jail because my eyes looked messed up. I really want to know if I have a case I feel the whole pullover was a joke and it shouldn’t cause me money cause some cop was a dick. AKA my license plate tags were fine that’s why my lawyer said the whole case will get thrown out I just wanna know if I can press charges against the cop…I rather him pay for my lawyer than me.

I’m a writer, so this is for a fiction piece, but it needs to be legitimate with the reality of law. Let’s say you’re driving one night drunk and you run a car off the road. The next morning you drive by the crash site and a cop matches the description with your car. Can he come after you and pull you over based on the suspicion? Can he arrest you for a DUI from the night before?

In August of 2001 i was 19 yrs old and pulled over and arrested for dui, simple poss of marijuana, and sched something drug poss….I am honest i was drunk and high on pot but the pill capsules they susposevly found must have been dropped by one of other arrestys in my car there were 3 of us i don’t or never have done pills anyway, I was taken to drunk tank where i spent night went before judge next day and plead guilty to simple poss of marijuana , dui was dropped, and charged with poss of controlled substance..it was pain pill capsules so whatever controlled substance that is but it will be 9 yrs since and only other trouble i have is a DUI in 2003 which was dropped to reckless driving because i blew .10 on july 3 of 2003 legal limit went from .10 to .08 July 1 of 2003 so cop helped me out in court but anyhow i cant get the 2001 charges expunged cause of guilty plea and i want to be a police officer so bad i have had no trouble at all since 2003 and i went into marine corps July 2009 after boot camp was promoted to pfc then was honor graduate of my mos school and was promoted meritoriously to lance corporal i have all doc of this so with this, im currently in marine corps reserves , bad record long time ago and good record now would a sheriff hire me here in Tennessee and what are odds if i just sit down with both good and bad paperwork i could be a police officer and serve my community.

it was aggravated dui(no insurance),and improper lane usage,and dui,and no insurance,and ilcs(agg diu and no insurance so 5 tickets all misdemeanor.no prior records this is a first offence.what will happen?
the cop told him they would drop them all and make it a felony

My dream job is to be an animal cop. I would also like to be a youth correctional officer, a juvenile counselor or a dispatcher, but i’m afraid i ruined my chances with the DUI 2 years ago. thanks ahead!

So why are not pro drink drivers protesting as well.

If a cop sees a car driving all over the place and stops some guy and he looks intoxicated and stinks of alcohol then he can give him a sobriety test.

If a cop sees a car doing the same and stops a guy who has no license, registration, insurance and cant speak english isint that reasonable suspicon that he is an illegal.

One of my best guy friends was driving home from work and stopped at a gas station to smoke (okay, not smart but whatever) and further on down the road got pulled over. The cop asked if he had drugs on him or in the car, he said no (he already smoked it). Then the cop asked if he had any paraphanilia on him and he said yes i have a pipe. The officer asked for it, he gave it to him, and the officer said, "you just saved yourself from going to jail."

The cop also asked if he had been smoking and he said yes. The officer thanked him for being honest, and said stuff like "Why are you doing this stuff?" My friend said he just started because he was stressed out.

In the end, the officer only wrote him 2 tickets: 1 for possesion of marijuana (resin in the pipe) and the other for possesion of paraphanilia (the pipe).

Luckally he was cool and didn’t get him for DUI. I was so relieved when I heard this, however, I was looking up penalties for Marijuana in Missouri and it said less than 35 grams is up to a year in jail and ,000 fine!

So now I’m freaking out and he’s freaking out and I was just wondering if anyone had ever been in this situation before (even in another state) and what punishment they got.

Also, he has a clean record, only been pulled over once for a traffic ticket! AND if they didn’t arrest him that night, they’re probably not going to, right?!

This guy I met at a party last night said that he was speeding and saw a cop from a distance turning his lights on, to pull him over.

He said that he reached into his pocket, pulled out a gram or so of marijuana, and just swallowed it quickly.

The officer smelt marijuana and searched the car, but did not find anything besides a baggie, which obviously smelt like marijuana and likely had marijuana in it previously.

He didn’t get arrested or anything.

I thought this guy was really lucky. Couldn’t he have gotten a DUI, or could they have done anything about the baggie, although there was no weed in it?

I am in the car with my friend, I’m in the passenger seat and he is in driver, a cop searches the car and finds a little bag of weed under my seat. The drugs are not mine and I tell the officer that. My friend is not there because they took him away for DUI. I get arrested. I tell them to give me a drug test, but they don’t. The drugs were not mine and I ended up getting a court date and a ticket for possession of marijuana. I payed my 100 dollar bail(10% of the 1,000) and was released, what can I do about this?
