lol...geez...glad so many people can judge...I was asking for a clarification of the law as I have a bet with my brother. I got dui when I was 28...I have not gotten behind the wheel with ANY alcohol in my system since. I rarely drink as my &quot;partying&quot; days are well behind me but thanks for all the concern from people so willing to judge...I asked for clarification on the law not advice to live by...lol...morons....</p>

Does the punishment matter for the state (CA), or the circumstances... (he was in a drive thru and a cop went up to his window) or does anyone know where I can find out the info on punishment?  Asking because my guy really wants his brother to move to where we live and get out of that black hole of destruction that is our home town... lol.  Anyways, I hope he learned his lesson, I'm thinking he might have to sale his 1999 Toyota Tacoma to pay the fine, which I thought was a universal ,000.00 for a seconf offense.  BUT I would appreciate any info.</p>

He said they never mentioned a blood test.  Never asked so he never refused.  The first cop's breathalyzer wasn't working so he called back up so he could use the other officers.  He said that the police was very nice.  He was pulled over for going 58 in a 45.  There was no accident or anything.  The officer apparently thought he was showing signs of drinking so he did the sobriety tests.</p>

The insurance company is requiring that I show proof of insurance before removing him from the policy.  They are telling me there is no other way to remove him from the policy due to a DUI charge.  Is it even possible to get car insurance without a car?  What should I do?<br />
I have been in contact again with the insurance company and here is what they wrote back &quot;The only proof we can accept to remove youthful driver's is Proof of<br />
Other Insurance.&quot;  What is the age limit on a youthful driver?  My brohter is 24.</p>

He has recently been charged with both a DUI and impaired charged. Also, with those charges, he has fleeing the scene of an accident, and harassing an officer. He was seriously hurt, but refused EMT. There was one witness who is testifying that he should get charged a maximum penalty. His only defense is that when they arrested him from his girlfriends house, his mom did not give permission for the cops to go into his house. What do you think he is going to get in terms of punishment? </p>
