A friend was arrested for that and the officer did not adminster the breathalyzer or any other tests, like one would get for a DUI. She had to spend 2 hrs in jail, and then released. And will she have a fine and have to do community service, attend classes, or even serve more jail time? And if required by law that she should have had those tests done, will the case be dismissed ?

i live in ky and have my licensed suspended for one year for DUI(2nd). Can i get a hardship license or get a breathalyzer installed on my vehicle during the suspension?

I’m 20 yrs old, I got my first DUI like a few weeks ago..I was driving while high they say..I wasn’t drunk at all but high so they say. When I took a breathalyzer it came back 0% Should this look better for me? They said they found a little under a gram of marijuana in my car..I was ticketed for missing headlight (didn’t even know, was the real reason i got pulled over, failure to yield, no insurance, no seat belt..all BS..Judge said he they wouldn’t appoint me a public defender because I wouldn’t be at risk of serving any jail time anyway..and he gave me time to find a lawyer or to defend myself..I said i would get a lawyer but I’m just wondering how much that will cost my parents..Ive heard crazy shit like ,000..Sounds utterly insane! I wasn’t even drunk…I live in Memphis, tn..Can anybody give me any ideas of how much this will cost? Because I mean if it costs even ,000 I’m just going to defend myself because that’s just ridiculous..I doubt that much worse would happen if i DID defend myself..Someone told me at the level court or something it wont go on my record or anything like that anyway so there’s no way in hell i would give an attorney that much fuckin money..Can someone help me out here
It was BS because they NEVER asked for my insurance! I had my insurance card in my freakin wallet..They just wrote a bunch of tickets
I will admit to the headlight being out but the seat belt, failure to yield, no proof of insurance are all bogus..Have you not heard of cops just writing tickets because they are assholes?

I got a DUI back in April. I blew .122 on the breathalyzer. I was wondering, if I agreed to plead guilty, do you think that they will drop the additional charges of reckless driving and misdemanor drug possession? This is the first time that I have ever been in trouble and I asked my lawyer to see if this is possible? What do you think? Especially those of you with legal/law enforcement experience.

does anyone know what one glass of wine would equal on a breathalyzer or anyone know a website that discusses this and maybe dui laws in ny state?

What it means? It means you beat the wrap you lucky SOB. I got pulled over blew a .06 they still took me to jail and booked me for a DUI. I was not very cooperative with the arresting officer. That may explain why he arrested me. 2 weeks later I got a notice saying charges have been "set aside" from DMV. 2 weeks after that I showed up in court as ordered. My case was not on the docket. I asked the DA’s office why not and they said, I could walk "lack of evidence to prosecute". So I did. Also remember only DMV has the authority to revoke your driving privileges not the criminal court. IF the DMV say charges have been set aside the DA aint got a pot to piss in. You can walk. They might get you for the speeding or what ever bs the arresting officer said was "probable cause" in my case they did not do shit. Don’t trust cops. Its this mentality that got me off. If I would have believe that cop I would have been screwed royally. Did not blow into the field sobriety tester and passed on the "Roadside Olympics". I told them to arrest me and take me to jail, they did. Since they had nothing to book me on they offered me the breathalyzer again. I took it but it was 2 hours later. I totally passed. Spent the night in Jail, car got towed, had to pay to get it out. ETC. cheaper than filing an SR22 sunshine. So yeah, you got off. But guess what I just got a ticket today for a california stop. IF you live in SF bay area be careful man. I have lived here my whole life (47 years) and have never seen it this HOT! Cops are enforcing everything.

My soon to be ex received a dui in nov 2008, she had three open containers, refused a breathalyzer, and was extremely belligerent and insulting to the arresting officer. She has a lawyer but i just cant believe that she can be found innocent with three open containers at 330 am. it has been over a year now but nothing has been done yet.

Late on a Friday evening I was at a 7/11 kwiki mart in MA. I bought 2 sandwiches, and a drink and was paying for the the purchase at the register when 3 police cruisers pulled up.

The officers entered the store and inquired if the the silver ford taurus outside was mine. I answered that it was. They ordered that I step outside the store immiediatly and take a field sobriety test. When I inquired why I was being taken outside, they answered that there was an eye witness account of my car driving the wrong way in a nearby highway.

I explained to them that it was not me and that I had not driven on that highway at all that day. My keys were in my pocket, my car was off, and legally parked. Regardless, they took me outside and demanded that I take the nine step turn field sobriety test. After that one test, and not requesting any others, they asked me to take a portable breathalizer, which I refused.

They arrested me on the charges of OUI and Driving to endanger. When I was brought to the booking station, I once again refused to take the brethalizer, which means an automatic 180 day suspension of my license. I spent the night in jail, and got my car out of tow the next day.

Is this legal? I was not observed driving by the officers, was not in or near my vehicle, was in a private establishment and was only given one field sobriety test.

I did hire a lawyer. Based on your experiences… what will be the result of my situation? Was this a legal arrest, did the police officer have probable cause?
In reponse to a few answers:

1) It was at night
2) It was not me who was driving the wrong way on the highway, of that I am certain.
3) I was advised by my friend who is a lawyer to never take a breathalyzer if you have had anything to drink in the past 6 hours, as a reading over .08 means an almost automatic conviction.
Making negative assumptions on my character or rude remarks like "get a bike" are unnapreciated.

So, I was driving and crashed with a traffic arrow trailer belonging to a private company,no other vehicles were involved,the arrow trailer did not suffer much damage but my car did an estimate of 000.The police came made me take the sobriety tests and the breathalyzer and charged me with DUI with property damage to another.I reported the accident to Mercury Insurance after spending a day in jail,I told the adjuster everything that happened including being charged with DUI ,and he told me they were going to take my car to a collision center to make an estimate.Today the guys at the body shop called me and told me the estimate was 000 including towing expenses and that I should receive a call from Mercury Insurance for further instructions.I have full coverage with Property Damage liability ,Bodily Injury Liability ,and my deductible for the 000 is 0.Right now I’m worried they won’t pay for the ,000,So,Are they responsible to pay for my car damages even if I was charged with DUI?
