I was pulled over for tossing a cigarette out of a window on halloween. Cop was part of a task force in Glendale, CA to bust DUI’s. I just pulled into a gas station I admit I did not signal and did toss a cigarrette out the window. First I was asked if I had been drinking I said yes at dinner. Followed by being accused of smoking marijuana over and over and over again, even after being handcuffed. Cop said my tongue was green. After about 30 minute FST I submitted to breathalyzer and blew .082. This was about 45 min after dinner. THen taken down for blood test. I do not know those results yet. The cop constantly berrated me for questions and explanations for my behavior. For example he asked me to stand with my feet together and hands at my side. Instinctively to be comfortable I put my hands in my pockets and spread my feet a few inches. After doing the 9 step straight line test I spined on my feet and walked back, which he said he believed I did not do as he said which was to take small steps in turning. yes I was legally drunk when he did breathalyzer according to it, I do not know when he pulled he pulled up behind more in the gas station or when I got the blood test.

Friend was in car with me, she can testify to how they treated me. Documentation also proves how distracted they where. They were so busy staring at her that they put her birthdate down on the DMV form rather then mine.

First question what are my options?
Second question do the cops have right to belittle and do everything they can to try to scare a confession out of a person like this?

I have long hair, and used to have bad teeth so have been accused atleast dozen times in past 10 years of being a drug addict, drunk etc.. even with no drinks or any other substance in my system. One cop told me I exhibited being under influence (I get nervous now around cops), other admited way I look is reason. Both of these never charged me. I have almost accepted I am persecuted for how I look, but still makes me nervous. This is my first DUI.

I currently have a DUI and DUI drugs charge against me. It is my first offense and I have a clean record. The DUI is going to be fought as I had a fever and suffered an Asthma attack during the traffic stop. I was denied my asthma inhaler which effected my oxygen levels and had an anxiety attack on top of that. I am a regular marijuana user and had a blood test taken. The results will obviously show marijuana use within the 24 hours of arrest.

MY questions are: Can the charges be dropped or reduced with a clean record? Will my license be taken away and for how long. Is there any way to dispute the license suspension? Will I be able to receive lenience as I am a full time college student and work full time? Any additional information on DUI/DUI drugs charges in Phoenix would be helpful.

Okay so my brother in law is an idiot…

He has 3 DUI’S one he just recently got last week. the first two was for having alcohol in his system and this recent one was for failing a blood test for marijuana.

I AM COMPLETELY AGAINST ANYONE WHO HAS HAD A DUI AND HAS PUT OTHERS LIVES IN DANGER….

What will happen to him? what are the consequences? it seems to me like he has gotten off easy from the judge the first two times…

BY THE WAY he will make 21 in december!

I ask this because he is staying at my home and i dont want him there but my husband cant turn his back on his good for nothing brother. he is still smoking weed and his license were suspended and he is still driving around…

im not an evil B**** but i have children and if he cant change after his 3rd offense i dont want him near my kids or have those substances around my new home….
Basically i want to know what is his chances of going to prison….

what extra charges do you get? how can he combat this without pleading not guilty? this is disgusting…help. he can’t get his hardship license for 90 days now because of it

he took the test, i saw it. however i just found out he wasnt blowing hard enough. the policeman gave him 3 tries and then stopped. i guess this counts as refusal? ive never felt more angry. to the first answerer, you are a scumbag if you believe someone should lose their hardship license and not be able to drive to work for 90 days and you are more of a scumbag if you think any of those people get drunk within that time frame. commit suicide with the two sided sword of your own ideals

i guess i should clarify that the 90 days without a hardship is directly because of a breathalyzer refusal charge, and there is 6 months added to license suspension. BUT WE BETTER KEEP DEM WORKING CLASS PEOPLE OFF THE STRETE TO WORK FOR 3 EXTRA MONTHS SO WE R SAFE DRIVING TO THE K MART..THEY GOT SOME GOOD DEALS THERE AT THE INDIANA K MART!!! he wants to plead guilty and pay all the fines and do community service etc but the fact is that he does not get his hardship work license for 90 days now because of this non communication. the cop purposely wrote up the ticke tbefore the breathalyzer test so we would have no idea he put him down as refused. ugh
he did go to prison, garbage marine guy. he was bailed out. it’s a regular dui. this is added on. oh my god what is wrong with you horrible people who have no idea what youre answering about
yeah, he didn’t get a machine test. i guess we do have a "case" per se but a dui lawyer is like 5 thousand isnt it..he was meaning to plead guilty and still is. im glad theres some helpful peopl ehere

My friend recently was caught driving while intoxicated. He did the walking test and blood test and he passed. He is going to court soon, so what might happen to him?

So I just got a DUI the other night in Scottsdale Arizona. I was celebrating my friend coming home after not seeing him for a while. We decided to smoke some pot and then go to the bar. Well I got pulled over a few hours later, and when they took me to the station they had my blood drawn. I haven’t smoked weed in months prior to this so I’m a little worried. Will The marijuana show up in my blood test? Will they even look for it?

Last year, my boyfriend was taken to the police station after an accident and was given a blood test for DUI. We had been waiting for the court date, but never received anything or heard anything since then. Is there a way to find out the status of this without having to pay for a lawyer? Since we never received a summons, I am a little worried. Shouldn’t the summons come in certified mail? Since it has been so long, could he possible have a warrant for his arrest? We are in the state of Pennsylvania.

His license has the correct address and the officer came back to my house directly to return the insurance papers when he was at the station. I am sure they had the correct address. I have no idea what could have happened.

Well I’m looking to find some information on California DUIs. I received a DUI and didn’t receive a ticket for the reason I was pulled over (expired registration) . I passed all test given to me. Later brought down and given a blood test. Waiting on the results. I have been told that if they don’t ticket you for the reason they pulled you over for then it is to be dismissed. I’m on informal probation but I’m sure that doesn’t change the situation. Looking for any help. Also to if you could in the answer provide the source of your answer. Thanks for the help
i was not speeding, swerving, not doing anything wrong. he merely pulled me over for my registration.

a friend got arrested on a dui. she opted for the blood test. it came back with a BAC of .27.
3 weeks later before even going to court or being convicted, her lawyer told her they failed to put in a preservative in the vial before adding the blood and therefore the alcohol has duplicated itself and it now shows a .31 BAC so he is trying to get the charges dropped.
what happens in a case like this? can it be determined how fast the alcohol duplicates itself in a period of time so that they can actually tell what the BAC would have been before it started to duplicate?
hopefully i am asking the right thing i heard this from her while she was drunk so it didn’t make allot of sense (you can skip the comments on what a drunk she is-we all know it already). she says her dui will be dropped. i say BS and hope it isn’t. she needs to learn. and i can pretty much guarantee it was at least a .27

I understand you shouldn’t be driving high on pot but lets say you get pulled over and the officers suspects you’re high as a kite but doesn’t smell it in the car.

There’s no roadside test and testing for pot in general doesn’t work because of the I did it a week ago excuse. In these instances I understand they can do a sobriety check but even if the individual fails there’s still no physical evidence.

In court for a traditional DUI if the individual fails the sobriety check the actual breathalyzer is the physical evidence.

Is it possible for a prosecutor to get a DUI conviction for being high on marijuana if the defense has a lawyer as well.

Basically if with a competent defense attorney are there any scenarios where a prosecutor could successfully beat the defense? The big given there’s no physical evidence other than a failed sobriety check but as I understand that in itself is meaningless without any additional evidence such as a breathalyzer.

How could prosecutor win this case against a competent defense attorney knowing there’s no physical evidence?

I don’t think so. For a normal DUI they need the breathalyzer to back it up… My scenario involves a good defense attorney, I think s(he) would tear that up.
The blood test would be meaningless, could have smoked pot a week ago.

The failed checkpoint could be a result of cold medication as a previous answer states.
Blood tests are meaningless in proving DUI at the time… despite if it tests concentration. Also I believe it’s illegal to do blood tests or anything involving needles.
Blood tests at the time of the infraction are illegal and it would be an after the fact test if court order… this would prove nothing since it wasn’t during the time of the infraction.
I have to consent to a blood test, without my consent there’s nothing. You don’t get the option of blood testing without my consent, who in their right mind would allow this invasive test to be done?
