My roommate was arrested for DUI this past weekend, her BAC was 1.25 (legal levels in MI must be below .8). We're just wondering what kinds of fines and/or penalties she's going to be facing after going to court. She's already hired a lawyer who's charging her a 00 flat fee.

The situation is this:
I received a Minor DUI in WA state which is defined as:
- Driver under 21 with BAC over .02 and under .08 (which is classified as a misdemeanor)
I've moved to Texas since that mistake and am looking to get a Texas license.. The incident incurred a 90-day license suspension period in WA, which is already up. How does this play out?
Will I be eligible here in Texas?
Do I need to have an SR-22? My insurance company hasn't yet gotten wind of the infraction so I'm still insured normally, will the Texas DPS notify my insurance company?
If it were possible I'd like to just apply as a brand new applicant, like I've never had a license, but looking over the application where they ask if you've had a license in another state, short of lying (which is a felony i think), it doesn't seem that will be possible. I assume that they run checks on your name or social security number in other states?
What other things should I know and/or consider?
Thanks in advance for any and all help and information.

First time DUI, BAC is gonna be higher than .20%.
Also a hit n run misdemeanor. Property damage should be no more than 0.
Need a damn good attorney, money is not an issue i just need the lowest possible sentence.

i crashed my car while driving under the influence. i did not hit anyone or hurt myself (thank God). As i was about to call a tow truck to tow my car , there comes the police. They asked me few questions which led to sobriety and breathelizer test. I scored 0.11 BAC above the legal limit, arrested and jailed for DUI. I will be going to court soon. My lawyer wants 00 to represent me in court? should i use my lawyer or just go with a public defender? what kind of fines/penalties am i gonna be expecting? what preparations should i make before the court date? this is my first dui case so any advice will be appreciated. trust me i've learnt DONT DRINK & DRIVE.

so just wondering if you have no criminal past, no previous arrests, a clean record, what is the penalty if its a first time dui offense, if the bac is half of the illegal limit?

a friend of a friend of a friend got a dui in sacramento county. this person asked for a blood test and tried to say he wasn't drunk. but did smoke pot and drink alcohol. he wasn't thinking that the pot would show. (that's why they call it dope right? lol ) blood test came back at .31 which is 4 times over the legal limit. my question is.. which gives a higher BAC reading? pot or alcohol? with my knowledge of this person both alcohol and pot are used heavily everyday.
another question i have is where can i find the penalties for 1st offense. i know the standard penalties but will there be a stiffer sentence with mandatory jail without community service option because the limit was so high? and because this person was reported to 911 by a concerned citizen which is how he got the dui. (they never did pull him over but had the location of where he went so they went to the location where this person was already out of the car and inside the building)
please don't respond with what a loser this person is. we all already know he is an idiot for doing this and deserves max penalty. i say he is wasting money on a lawyer. how can you fight .31?
i want to know because one of my friends is soon to be highway patrol and we are arguing over who is right and wrong on some of the issues. one says calif. does not utilize special circumstances in penalties and one says this guy will be going to jail for a good period of time. and will not be allowed comm. service or restricted license and will have to do at least 18 months of classes vs. 4 months on 1st offense.
anyone know the facts on this? no guesses please. my dollars are at stake here-lol
