Here’s the situation. I was pulled over for a DUI. When the officer pulled me over and gave me a breathalyzer test at his car I blew .08 and that is what was written on the citation. When I got to the police station I was given another test and blew a .11 which is signifigantly higher. My question is, when I go to court, will I be charged with the BAC that was written on the ticket (.08) or the .11 I blew at the station?
My boyfriend and I have been together for almost 2 years. When he was 19 he was pulled over and had a BAC of less than .08 (the legal limit here), but because he was underaged he was charged with a DUI. Last June he was pulled over for speeding in the state of Wisconsin and the officer asked to search his car. He found a smoking device and a small bag of marijuana in the car, so his blood was taken and came up positive for THC (even though he hadn’t smoked for somewhere between 12-24 hours) . He was charged with a DUI, possession, and possession of paraphernalia.
Needless to say, he no longer smokes pot. It is just too risky now.
Will these charges be enough that we are not able to rent an apartment from a place where they do background checks? Or are those mostly searching for violent crimes and felonies?
Please answer my question and do not give me your opinion on my boyfriend or my relationship. That is not what I am asking for and it is quite annoying when people do that.
I wish I could rent in my name, but he is graduating college in April and will be the one working full time & making a much better hourly wage than I am. I am still attending college full time & only work at a bagel shop on weekends. I’d like to get my masters so I will have at least 4 more years left in school, maybe 5 or 6, and if we can’t rent an apartment on his income we won’t be able to move out until I graduate.
I need some help, Got pulled over in ND for DUI, but got a VA license. I’m moving back in January with my wife. Can I still apply for a Restricted License? My job is an Electrician, will they hire me with a Restricted License? Will I have to do the whole VA DUI Charges on top of my ND fines & punishment? I’ve got a yr. suspended license, ASAP and fine plus an EVAL. VA has the same laws basically with the suspension, ASAP, Fines, and the Inter-Lock Breathalizer. Help me out, stressing out, he needs a job. Will he still find a job?
My husband got Pulled over 22AUG08 for speeding, he got a warning on it. But they took him in for open container & DUI. They didn’t give him the BAC, but kept him over night. He pleaded guilty to his charge without a fight. His punishment was 1 yr. Suspension of his License 22 days after the incident, ASAP, a Evaluation (for treatment) and a .00 fine. Now with VA laws 1 offenders get a1yr suspension too, ASAP, and fines. Plus this Inter-lock thing. Will he be subject to deal with VA’s laws since he has a License there? He hasn’t resided there since Jan 2008, but will in Jan 2009. Is a Restricted License for work still applicable, since he will be in VA? How does that work? Isn’t it like Double Jeopardy or something? I’m getting a new car, do I have to put him on my Insurance? I don’t want too since he can’t drive for a yr. This sticks on his Point System for 5 yrs right? Please help, trying to find a method to the Judical Madness. Thank You!
Car towing with a dui arrest in Allentown, PA?
I was arrested for a dui last night and went to get my car where I left it and it wasnt there. They did not tell me they where towing it nor where. First off, can they do that? Secondly, where would they tow it in Allentown, PA or how can I find out where? Does anyone know or can find it, I haven’t had much luck. Thanks!!
my BAC was 0.09 which is 0.01 over the legal limit….. If I didn’t feel I wasnt able to drive I wouldn’t have. I havent eaten anything substantial in 5 days due to my medication so the alcohol absorbed more than it would have into my system.
i got arrested for a dui. my bac was .12. ive never jaywalked in my life and was ultra cooperative during the arresting process. im 23 yrs old. will i have to go to jail for this??

My 20 year old brother was drinking last night(apparently a lot) with his friends in Santa Cruz california. Today he drove home (about a 2 to 3 hour drive home) He was almost home and got puuled over for speeding. He was aressted for a DUI. He breathed a BAC of .14 at 3:45 p.m. I think he’s screwed. ANyone have any advice that would help ANd what he might expect to be facing. He also wants to be a fireman but is now afraid that he is screwed because of this. He didn’t think that he was still drunk because he drank last night. He just thought he was hungover.
He is really a good kid and hasn’t been in trouble before and wouldn’t have driven if he knew that he would blow any BAC number
5 year years ago..when i was 20 and in college…i was arrested for DUI. BAC was .049 which is friggin retarded because if im 21 then everthing is ok cause i would be under .08…your gonna tell me age 20 and 21 makes a difference with being drunk….that is the stupiest thing i have ever heard…anyway, i have a CJ degree and work in loss prevention…and i want to be a cop…is this gonna hurt my chances. I went through a program for first time offenders (community service and blah blah) so the charges were dropped…i got stopped for making a illegal left turn which i always do at that street only this time a cop was sitting there…bummer
I was involved in an accident (with a parked car) last night & was given a DUI. My BAC was .17. I am 18 years old about to be 19 & if possible, I don’t want to tell my mother that this happened because she will freak out. My question is, will my insurance company be notified that I was given a DUI? I will need to pay for the damage on the other car so they will be notified that I was in an accident. If they notify my mom (she is the insurance policy holder) & I haven’t told her first, she might murder me.
Long story short: DUI. Accident. Will the insurance company find out about the DUI if they know about the accident?
a friend got arrested on a dui. she opted for the blood test. it came back with a BAC of .27.
3 weeks later before even going to court or being convicted, her lawyer told her they failed to put in a preservative in the vial before adding the blood and therefore the alcohol has duplicated itself and it now shows a .31 BAC so he is trying to get the charges dropped.
what happens in a case like this? can it be determined how fast the alcohol duplicates itself in a period of time so that they can actually tell what the BAC would have been before it started to duplicate?
hopefully i am asking the right thing i heard this from her while she was drunk so it didn’t make allot of sense (you can skip the comments on what a drunk she is-we all know it already). she says her dui will be dropped. i say BS and hope it isn’t. she needs to learn. and i can pretty much guarantee it was at least a .27
