Last night, my friend was arrested for 'driving under the influence of cannabis. He wasn't in possession of it. But his car smelled like it. He passed a field sobriety test, had no alcohol in him and denied that he had been smoking. Still, he was arrested and I had to bail him out. Is it possible for him to fight this in court?

There was no crime committed. It is not illegal for your car to smell like weed. His friend with him was high, granted, but he wasn't. He was pulled over because his turn signal didn't go on whenever he turned.
In addition, no drug test has yet to be enforced.

i got a 2nd dui arrest, the first time it was brought down to wreckless driving.
This time i was not drunk, but my breath smelled like alcohol and even though I passed the sobriety test I was still arrested. Later i refused to take the breathalyzer. What r my chances of winning this case and is it possible to get my license back if i get a lawyer?

I was arrested for DUI about 6 months ago (no drugs or alcohol in the car, but I blew a .17, I was DRUNK)...I am 21 yrs old and had a squeaky clean record. This is my first charge ever, so I got youthful offender status or whatever. The judge said if i complete 80 hours of community service, attend a lvl. 1 drunk driving class, and pay my fines that my DUI charge will be ERASED OFF MY RECORD.
Last week I went to my court refferal officer and took this silly written test to conclude or not weather I was an alcoholic. It was deemed No i wasn't, so I have to go to lvl 1 drunk driving class. The CRO issued me a color telling me I have to call this hotline on weekdays, if it lands on my color I have to come in the day of and take a breathalyser test. She then handed me my paperwork telling me my color was silver....in the paperwork it says when I come in I am subject to a breathalyser/urinalysis. Since I have no drug charges and this is not drug related, will I have to piss test also?? My CRO herself never said anything about a drug test, just breathalyser. Yet in the paperwork it says I could be drug tested also.
My question is...do you think I will be drug tested anyway? will the state spend money on a drug test since I have no drug charges? or will I just have to come in and breathalyze?
a small FYI... the only drug I use besides alcohol is marijuana. I smoked daily for months before, but I quit the day I met the CRO. (A week ago). I know how THC works in your system and how to pass drug test yadda yadda all I want to know is will I be drug screened for a purely alcohol related DUI??

They cannot hire anyone with a misdemeanor until 2 years after conviction. Its been over 2 years since my DWI which was reduced to "driving after illegally consuming alcohol" (given to persons under 21) which is also a misdemeanor.
They do a background check and are going to find this out anyways , so my questions are:
1. Do I have to write this down on the application?
The application asks you to "specify criminal charges. For all other answers, fill in the disposition/comments section"
2. I dont know if its considered a traffic or criminal violation?
3. I am afraid they will not hire me, I previously applied 1 year ago and they told me after I got the job that b/c the background had a misdemeanor I have to wait 2 years. Ive waited but I am nervous they wont want me anymore. Does this mean I have to pay for this every single time I apply for a job (i know i did something wrong but Ive learned and I dont want to still be paying for this 10 years from now)

I'm on informal probation (no probation officer) for an alcohol DUI. I have less than a year remaining. I was just pulled over and the officer found that I had a "suspended license." The reason for this was that I changed insurances and my new insurance agency hadn't informed the DMV yet. This caused it to come up suspended because in order to drive in California, you must be insured. Also, I got a ticket for possession of marijuana that was an eighth or less. I have a court date next month. I'd love to know what to do in the mean time and what I could expect in court. I've already cleared up the insurance stuff...

What do you think about these laws in other countries:
In Australia, the names of intoxicated drivers are sent to the local paper and are printed under the heading: “He’s drunk and in jail”.
In Malaysia, the driver is jailed. If he is married, his wife is jailed, too.
In South Africa, the penalty is a ten-year prison sentence and the equivalent of ,000 fine, or both.
In Turkey, drunks are taken ten miles from town by the police and forced to walk back under escort.
In Norway, the penalty is three weeks in jail at hard labor and one year loss of license. With a second offense within five years, the license is revoked for life.
In Russia, the license is revoked for life.
In England, drunk drivers face a one-year suspension of license, a 0 fine, and one year in jail.
In France, there is a three-year loss of license, one year in jail, and a ,000 fine.

Here is an example of the penalties in the U.S. for the state of Arizona:
First Drunk Driving Conviction (Minimum Consequences)
0 fine (0 + 80% surcharge) PLUS another 0 for a "DUI Assessment" and up to 10 days in jail. Drivers license will be suspended from 90-360 days depending on the circumstances.
Second Drunk Driving Conviction (Within 5 Years of the First-Minimum Consequences)
0 fine (0 + 80% surcharge) PLUS another ,250 for your 2nd "DUI Assessment and up to 90 days in jail. Drivers license will be revoked for one year. You will also have to install (at your expense) a interlock ignition device in all of your vehicles. The vehicle will not start unless you blow into the device and prove that you have not consumed any alcohol.
Third Drunk Driving Conviction (Within 5 Years of the First two = Aggravated DUI)
50 fine (0 + 80% surcharge) PLUS a 0 DUI assessment PLUS a 00 aggravated DUI assessment. The vehicle will not start unless you blow into the device and prove that you have not consumed any alcohol. Your car may be forfeited to the state and sold (The money goes to the state).

If you're out driving and you happen to come across a checkpoint, what can you expect from them? Do they typically just shine a light in your eyes and talk to you a bit to see if you're visibly intoxicated, and then send you on your way? Is it true that there's a sensor in their flashlights that can detect traces of alcohol (if so, how sensitive and accurate is it)? Do they randomly select drivers to get out and dance a jig and give a breathalyzer? Do they also normally use a checkpoint as an opportunity to bring around a drug sniffing dog as well as check all cars for equipment violations, or do they just focus on catching the drunks?

Ok..i'm in sort of a big predicament. My bf and I got pulled over and he is, I believe, charged with a dui. He has recieved a dwi in 04', so I'm really stressed out and nervous here. I was actually the one that was too drunk and had called for him to pick me up at a friend's house...had way too much to drink, i know...uncool....he came over and hung out for a little bit and had a couple of beer....but he's a big dude so couple of beers won't do anything to him...
Anyways..it was about 2:30 in the moring when we got pulled over...My bf confessed to having a couple of beers and I told the officers the whole story....they administered the Sobreiety test?..on him while i was in the car...I wanted to get out to explain to them but they insisted i sit in the car...anyways...i could hear the officer telling my bf that they could totally smell alcohol on me and not much from him....i also pleaded with the other officer that it was my fault that i had called him to come pick me up and i didn't want him to get in trouble because of me...he assured me everything would be fine and that it seems my bf is ok....well i guess he did ok for the first test but then they did the breathalyzer test and i guess thats where he failed....
Anyways i don't really know about any of these things...pertainig to dui laws and stuff...Im a big goodie goodie....i can't believe i allowed this to happen....but my bf told me they didn't discuss with him anything ...like if he passed either of the test...or if they were gonna charge him anything....they just told him he had to go to jail for 6 hours to sober up and that i can pick him up in the morning...they actually even drove his car home for him....his court date is coming up in couple of weeks and i've been checking stuff up online....should he get a dui attorney???...considering this would be his second offense...and also since he was charged with a dwi the first time...say he did get a dui this time...would that be considered a second offense or a first offense?...are they two different thigns?....
my bf is 28...he was a bit of a trouble maker in his younger days...but ever since getting with me he has cleaned up his act considerably....his record is clean though except for the first dwi in 04'...he makes a decent living...but has to support both of his parents aand me....i just finished school..still trying to find a job..so we don't actually have money to just spend...can i make payment arrangements for the attorney if we decide to get it...and lastly is this a lost cause because he did have some alcohol in his system...
sorry for so many questions....but since he hasnt been to court yet..is his license suspended or not ...can he still drive around legally?...I feel so bad...i know he should've made better judgement considering I was the drunk one...my bf also said at the time we were the only ones on the freeway....they said he was speeding...sorry for the long story....but i do need some advise...thanks....
