Felony Probation and got a DUI, what happens?
A year ago my brother was sentenced to 3 years probation for forging his gf's checks. We are talking thousands of dollars. It was mostly for alcohol. The judge put him on probation for 3 yrs with random drug & alcohol testing (which in a years time the court never did a random test). Well, about 3 wks ago my brother got a DUI. He got it for DUI, no ins, container, wrongfull u-turn. The breath test read a 2.8 alcohol level, here in NE legal limits are I think 0.8. He refused a blood test that night & had to b on suicide watch cause he kept mouthing off to cops in the jail. His gf bailed him out 24hrs later. He also got a ticket for fictisious plates on another car about 2 months b 4 and hasn't paid that ticket. He hasn't been paying all his probation fee's, etc drug testing monthly fee's, etc. He had court yesterday for his DUI, he asked 4 an attorney so they rescheduled his court for Sept 22. With his felony charge,DUI, probation, breaking probation, fictious plate ticket, then does it look as if he may serve jail or prison time. My brother has been in jail b for 4 bad checks. He hasn't been a good person. He needs to wake up and smell that rum doesn't go in the coffee. We live in Nebraska. Any 1 know where I may b able to find the laws for this. The family just wants to b prepared as to what may happen. I love my brother to death but we have all had enough and he is going to end up killing himself or others if he doesn't change. Any help or information or links would b greatly appreciated. Thank E1

A friend got in trouble with the law and now they are trying to deport him. Is there anything we can do?

My friend was born in Mexico but came here a few years back with his family. He graduated from high school 3 years ago. Recently he got in trouble with the law (DUI) and went to his court hearing and now INS is involved and they're trying to send him back to Mexico. I guess he had a student visa and it expired, but I'm not sure. I'm trying to find out if there is any way that my friends and I can keep this from happening. PLEASE HELP!

effect on NJ driving lic from Out of state DUI?

I live in New Jersey and was arrested in Minnesota on the DUI changes. For my court date I flew to Minnesota and finished up with my court , paid fines, etc. My lawyer said no more criminal charges. But, what are the effects of this DUI on my NJ lic? I mean I know that insurance will go up. But, will NJ DMV suspend my lic and charge me the state fee too (3000 over 3 years)

Do you have to insure yourself for 3 years after a DUI to get the rates lower or can you wait to drive?

If you have a DUI in California and you lose your CDL for a year, after the year is up must you obtain insurance for a solid 3 years to stop filing SR-22 or can you wait 3 years to drive to avoid filing the SR-22 form?

Getting a CDL license w/a dui on record in Co?

I am wanting to study for my CDL liscence, however, i am not sure how my past D.U.I from 3 years ago will have an effect on being able to take the test. If you know what the laws are in Co, for somthing like this, please let me know.

Which auto insurance carrier forgives a DUI in the least amount of time?

I have a DUI from April 2008. I was wondering if anyone knew of any auto insurance carriers who forgive a DUI after 3 years. I have Progressive and they forgive it after 7 years, so I am looking for a carrier who is more lenient than that because as it is I can not afford full coverage on a vehicle with this DUI reflecting in my insurance rates.

SR22 Insurance required after DUI Withheld Judgment?

In August I was sentenced with an under 21 DUI, and was consequently given 6 months probation and 6 months license suspension as well as a treatment program. I was also given a withheld judgment after successful completion of all my terms of treatment and probation.

My question is, once the withheld judgment is put in place will I still be required to carry SR22 for the 3 years?

My husband has 2 prior DUI convictions, one in June of 1995 and one in January of 2004. He recieved another in November of 2006. Is he facing a 2nd or 3rd DUI conviction ? The prior law states they can only go back 10 years to make it a felony. Under the new law it is a felony if it is a 3rd over any amount of time. Due to unusual circumstances he is just now going to court on the 2006 charge. I believe I'm right on them only being able to charge him with a second since this DUI occured prior to the change in January, 2007. Anyone know for sure ?? (And please, no comments on his past actions, he did finally realize what harm his recklessness could cause himself or someone else and has not had a drink in almost 3 years) Thanks !!
