Are DUI laws really fair when you can get busted when you weren't drunk?

OK, so someone lives a block away from their local bar. On the way from work, this person slams six beers in 15 minutes and gets in his car to go directly home. He is not drunk, as there is not enough time for enough alcohol to absorb in his system.

He should make it home in 30 seconds, but gets pulled over because a cop was staking the tavern out.

The driver refuses the field sobriety test (which is only an option) because of a handicap and is arrested for DUI. By the time he's down in the station giving a breath test, he is now drunk.

Are DUI laws really fair when you can get charged for DUI when you were not impaired while you were driving?

how far do the peace officers get go to borderline abuse of the entrapment laws?

I live in a small town where big trucks, big motors, and fast cars is a cool thing. I live abt. 10 minutes from the river bottoms where one day my fiance', me,and two other friends were on our way to the mud holes in our jeep. While riding to the gravel roads we had a convertible camaro come up behind us fast and revved his motor and then passed us in a no passing zone. After he did that he slowed down really agging us on but we just passed him and went straight on to where the gravel road began and he tromped down side ways and went around the curve on blacktop. Half way throught the bottoms a sheriff car passed us then turned around followed us abt. 1/4 of a mile then pulled us over cause the off duty officer said we were driving crazy and drinking granted my fiance had just started drinking cause we wasn't coming out of the bottoms we was just muddin and gonna camp there. They charged him with a dui however when they did the second test at the jail he wasn't over the limit?!.
AFTER BEING TAUNTED BY AN OFFICER WHO WAS DOING THE WREKLESS DRIVING PASSING IN A NO PASSING ZONE TROMPING HIS CAR SIDEWAYS WANTING TO RACE AND WE DECLINED WE DID HAVE BEER IN A JEEPWITH THE TOP OFF SO HE SEEN IT AND WE WERENT EVEN ON A STATE ROAD WE WERE IN THE RIVER BOTTOMS ON A GRAVEL ROAD

DUI question/California law?

Ok, if someone has a d.u.i. and they are a passenger in a car and the driver is intoxicated, could the passenger get a second Dui?
I am asking because my friend has a DUI and has to attend classes and he said he was told this. I dont think it makes sense so was checking to see if anyone else knew of this law. I know what DUI stands for :-)

A year ago my brother was sentenced to 3 years probation for forging his gf's checks. We are talking thousands of dollars. It was mostly for alcohol. The judge put him on probation for 3 yrs with random drug & alcohol testing (which in a years time the court never did a random test). Well, about 3 wks ago my brother got a DUI. He got it for DUI, no ins, container, wrongfull u-turn. The breath test read a 2.8 alcohol level, here in NE legal limits are I think 0.8. He refused a blood test that night & had to b on suicide watch cause he kept mouthing off to cops in the jail. His gf bailed him out 24hrs later. He also got a ticket for fictisious plates on another car about 2 months b 4 and hasn't paid that ticket. He hasn't been paying all his probation fee's, etc drug testing monthly fee's, etc. He had court yesterday for his DUI, he asked 4 an attorney so they rescheduled his court for Sept 22. With his felony charge,DUI, probation, breaking probation, fictious plate ticket, then does it look as if he may serve jail or prison time. My brother has been in jail b for 4 bad checks. He hasn't been a good person. He needs to wake up and smell that rum doesn't go in the coffee. We live in Nebraska. Any 1 know where I may b able to find the laws for this. The family just wants to b prepared as to what may happen. I love my brother to death but we have all had enough and he is going to end up killing himself or others if he doesn't change. When should I tell my new boyfriend about my DUI?

I have started seeing the man I really like and I am a very open person about everything in my life but here is my question: I have recently got a DUI (my only violation of traffic or any laws in my life) and I know I've made a mistake and I am very sorry of it. But I do not want to hide anything especially with the court day approaching. I know I'll need to tell him about it if I want to be honest in the relationship but how do I do it and when? I mean I cannot just say - oh, yeah, honey, I've got a DUI hearing next month. But on the other hand wouldn't it also be a test to see if he really likes me though I've made a mistake and honest about it?

No judgmental answers, please - I am to face the judge soon anyway and we are not all perfect.

Should all those convicted DUI people ask for the Hilton treatment?

You know this is not fair at all and it just makes me upset to see how money manipulate the laws!!. I wonder what would happend if all those people that had to serve time for DUI, ask the NEW! Hilton priviledge? I think she needs to be equal as every idiot that decides to ignore the law! It wouldn't be fair at all that she gets out! who agrees with me? and how come MADD is not protesting?
No, I don't feel bad because she brought this to herself! She is a rich girl! so she could afford a chofer!

A friend got in trouble with the law and now they are trying to deport him. Is there anything we can do?

My friend was born in Mexico but came here a few years back with his family. He graduated from high school 3 years ago. Recently he got in trouble with the law (DUI) and went to his court hearing and now INS is involved and they're trying to send him back to Mexico. I guess he had a student visa and it expired, but I'm not sure. I'm trying to find out if there is any way that my friends and I can keep this from happening. PLEASE HELP!
