A dui by itself is a misdemeanor.
A first-time DUI, (or, in some states, "DWI" — short for "driving while intoxicated") is normally charged as a misdemeanor, not a felony. But if someone was injured as a result of the drunken driving, some states will raise the charge to a felony — and if the victim dies, some of these
states will charge the driver with reckless homicide.
Also, in a number of states, a DUI will be raised to a felony if it is the driver’s second, third, or even fourth DUI offense.
"Misdemeanor" and "felony" are emotionally charged words, but what do they really mean? Whether a conviction ends up as a misdemeanor or a felony depends on the type and length of the punishment for the crime. Misdemeanors carry the possibility of incarceration in the county or local jail for one year or less; felonies usually result in a state prison term of more than a year.

DUI was never a misdemeanor charge. Driving under the influence was, and always has been a major deal. The only thing that has changed since then have been the increase in fines, and more jail time. But DUI is a serious offense. The reason it is so serious and even then it was serious is because you are putting others at risk. A misdemeanor is usually a crime that is punishable by less than a year in jail. You can serve more than a year in jail for driving drunk and depending upon how many times you have been an offender of this type of crime. It is a serious charge and it should be taken like it is.

DUI / DWI is a misdemeanor in most states.
DUI / DWI cases are charged as either misdemeanors or felonies.
Most first, second, and third drunk-driving arrests are charged as misdemeanors.
A driver who is involved in an accident, kills or injures another person, or who is arrested on a fourth DUI within 10 years almost always is charged with a felony.
