    Misdemeanor or felony; the answer varies from state to state. It also depends on what court the case was filed on.

    If it was filed in a city magistrate court it will be a misdemeanor. The city, however, has the option of bringing it to the higher (superior) court for felony charges.

    The individuals’ background, criminal history, and of course local rules all play a factor in the decision.

    It depends on he state I think. California DUI’s I think are felonies but they can decide if you can plead down to a misdemeanor.

    most applications will say other thatn traffic violations, so i htink they just want to know about criminal charges

    Yes. In VA it is a first class misdemeanor. It will show up on your criminal history too.
