I have a Misdemeanor DUI pending in Indiana, what if I don’t appear ? Will they come and get me ?

The prosecutor is addding the Habitual Substance abuser enhancement because I have had 2 other DUI convictions. We tried to plead but she insists on 1 yr for the DUI and 5 yrs for the enhancement and that is non suspendable! I live in Illinois now and am considering not going to court. Any Advice??
I will lose my livelihood if I go back. What if I get myself in a position to go back sometime in the futur and face my consequences? Are any of you lawyers or have had experience with this? Thanks
Does anyone know what the odds of them filing an extradition warrant is?

You will be in contempt of court and a bench warrant would be put out on u. Your license will will be automatically suspended.
No one will come after u, but your name will be entered in a data base and if you get stopped and or arrested anywhere……you will be held and whatever state has the warrant out will be notified and they will seek exposition to get you delivered to them.

GO TO COURT! if you don’t go to court it shows your lack of commitment to changing your record and shows disrespect to the judge thus making it easier for the judge to apply an even harsher sentence!

  3. Beware of scammers says:

They will most likely issue an arrest warrant for failure to appear. Better off to go and face the music, otherwise you will always have to worry about getting caught somewhere else and getting in trouble not only for the DUI, but for failure to appear as well.

  4. Citicop says:

They will put out a warrant for your arrest if you fail to appear.

It will NEVER go away. Maybe they come and get you, maybe they wait 15 years until you wind up back there for something.

They will also suspend your IL Driver’s License, and you’ll start racking up new charges in IL.

How about growing up and accepting the consequences of your actions?

Time to grow up. BLowing off a sentence is just plain stupid.

Go; and get your life straight before you kill yourself or worse, some innocent.

Yeah, go to court. If you don’t show for trial, they can 1) issue a bench warrant to haul you in, or 2) have the trial without you and convict you.

You are only making this worse. Face the music.

Yes, they will come after you. You’ll add criminal flight to your offense resume. That’ll bump it to a felony. Go to court.

When you get pulled over and arrested again they’ll get you and your punishment will be more severe because they will now have a warrant for you arrest. Don’t try renewing your license or registration after that either because the states are linked by computer now. I suggest being a grown up and going to court. You can run but you can not hide forever. How many DUI’s are you going to get before you stop being a moron? You hit someone I know when you’re drunk the court will be the least of your worries.

That’s a pretty ridiculous sentence, 1 yr. for a DUI +5, I wouldn’t go, change your name, and never go back there

Well, I hope you didn’t talk to the DA on your own without legal representation.

If you do not go to court, then you will get an arrest warrant in IN. The problem with that is even if you get pulled over for anything in IL, an IL cop will see it on their system and arrest you and probably send you to IN. If you want to risk it, and you think you can live like that then by all means do it but you will be facing a harsher sentence if you get caught.

If you go to IN later, you will only get arrested the second the court finds out who you are and they judge will not have mercy on you.

I recommend getting a consultation from attorneys in IN and hopefully you would be able to work something out or at the very least get a continuance. A defense attorney should be able to find fault

Oh and for citicop, I understand that you have a difficult job and I commend you. But also understand people make mistakes, even cops don’t follow proper protocol and it will be the officer’s fault for screwing up on a DUI for not following the SOP.
