If you get a DUI in Rhode Island, and refuse the breathalyzer test, then there is no criminal charge. Does this mean if you apply to a job, and the company you're applying to performs a back round check, that they will not be able to retrieve the misdemeanor DUI charge? When you do not consent to a breathalyzer in R.I, do you have a completely clean slate?

    I’m from Texas, not Rhode Island, but I suspect you have been misinformed about the consequences of not taking a breathalyser test.

    In Texas if you refuse to take a breathalyser your license is automatically suspended, this is not a separate criminal action or charge, it is an administrative one but the charge of dui is still on your record and the btr off to the side indicates that you refused the test

    I would simply ask a state trooper or a police officer that works traffic and dui arrests are in the normal course of their duty.

    Did you go to court or pay a fine for the DUI? I am surprised there isn’t more to this case than you are saying. Normally, refusal to submit to the field test gets an automatic license suspension. This is separate from the actual DUI charge. Most companies doing a background check are only looking for convictions on charges other than traffic offenses.
