help plz,any one knows what the charges are for a second DUI offence (misdemeanor) tho,within 5 years of first

the first DUI was a felony and it was 5 years ago.. the second was a misdemeanor dui.. it was a couple of months ago. is jail time a mandatory or could it be avoided? this happened in the state of CA. the first one was 5 years ago n the second one back in June. i was only a misdemeanor coz the drive...

this happened in the state of CA. the first one was 5 years ago n the second one back in June. i was only a misdemeanor coz the driver had .9 alcohol level.so any one knows what the punishments are?? is jail time mandatory?? or could it be avoided? is there options?

    You need to tell people what state you’re in. Nobody can give you an accurate answer without knowing what state’s laws you’re asking about.

    Ah, California law. Have to love it.

    If your last California DUI was a felony, your next DUI (within ten years of the first) is a felony again. It looks like it *could* be charged as a misdemeanor, but in my limited experience it’s charged as a felony.

    Any way to avoid jail time? I don’t think so, and I certainly hope not.

    you will do sobriety court, with shitloads of testing and you will lose your license for a time, and you will submit to AA many times a week and you will have to do a bunch of other BS, and if you fail and don’t do everything your required by this special strict probation, you will go to jail for about 90 days

    you probably will get community service and time served and your license will be gone for 1 to 5 years. Most likly get a couple of driving with a suspended license and then drive drunk again and wont learn until your friend drives drunk again and does time in jail and hopefully not for manslaughter.
