Well am a legal immgrant ,married and living in states ,i have a work permit ,unfortunately i had a misdemeanor (DUI) IT ' S THE FIRST TIME.my first interview with the immigration office is on january 10,and my court in january 12, do u think will affect green card,till now i don t have social secur...





Well am a legal immgrant ,married and living in states ,i have a work permit ,unfortunately i had a misdemeanor (DUI) IT ' S THE FIRST TIME.my first interview with the immigration office is on january 10,and my court in january 12, do u think will affect green card,till now i don t have social security number ,and i was driving with an international driver license,i don 't know the rule yet that i can't drive while drinking ,what do u think about my case ,is it better to leave or have a litttle hope to fight my DUI , and get my permanent resident ?

    A DUI misdemeanor generally falls under the "crimes of moral turpitude" category of immigration offense.

    A crime of moral turpitude is a deportable/inadmissible offense if the sentence is for 365 days or more regardless of actual time served.

    In addition, your case cannot be approved while this charge is pending. They will reschedule if the charge is still pending at the time of your interview.

    A second conviction for a crime of moral turpitude leads to automatic deportation and inadmissibility.

    You didn’t know that it was against the law to drive while under the influence? Isn’t that illegal everywhere? If not, isn’t it common sense?

    Get a lawyer. You are going to need it if that is your defense.

    Oh, and by the way, driving after just one drink is illegal too.

    Excuse me, but you didn’t know it was illegal to drive while you were in a drunken stupor? WOW! You certainly need to read up on our laws.

    You must tell the truth to immigration. Your driving under the influence charge will have a direct baring on whether or not you get a PR.

    you need to get a firm that handles both DUI and immigration, as far as preparation for the interview, immigration lawyer if you cant get a firm that does both
