He’ll probably get charged with possession, and that scale could conceivably bring the charges up to intent to sell, depending on your state. I hope your husband learns NOT to drive intoxicated, period.
Legalize cannabis, treat it like alcohol.
It is a Class C Misdemeanor. Up to a year in jail. Driving under the influence of alcohol is no better than Driving under the influence of wacky tabaccy. Either way.

Depends on his record and the judge really…….. I have seen people with more than that walk and seen some go to prison for 25 years or more. It really all depends on his personal situation. If it is a first offense he may be required to go to rehab or get probation but probably will loose his license for a while.
It depends on the state you live in. He could possibly lose his drivers license and/or fined, it all depends on the Judge.
Driving Under the Influence=Arrested.
Knowing he is actually smoking it equals=arrested.

The scale is your husband’s biggest problem, that kinda shows intent to deliver. Since they dropped the DUI they will most likely charge him with possession of MJ and Narcotic Paraphernalia (usually both misdemeanors). Hopefully, for you, they won’t charge him with Intent to deliver a controlled substance (a felony).
Pray that they won’t reconsider the Driving under the influence of Marijuana because he will most likely lose his trucking job once his employer learns of it.
Depending on his past criminal history he could see anything from probation to jail time.
It all depends on the laws in your state. Some states have zero tolerance for drug charges and they have mandated sentences in place. With a mandated sentence the judge HAS to give him that amount of jail time. Others states he may have to spend some jail time and probation. He may get a drug class if he has no priors. My advise since it was a large amount get a lawyer, he will need one. Because with the scale in the car also they could charge him with the intent to sell based on the scale and the amount that was found.
He may lose his job, where I work if you are involved in an arrest or drug bust or have to spend time in jail due to a drug or alcohol charge you automatically lose your job.

If it’s his second time might be the same because it was just an once they don’t want someone like him they want the big time drug lords so bless you luck this time, but be careful
DUI, loose his CDL, Possible Jail time. If you have children possible CPS intervention.
DUI and what was the scale for. Oh sure. . .possession and equipment for the use in sales. Six months in County as first offense.
I am really sorry but he needs to be more responsible and could have killed or disabled other people. A little time in the slammer will make him think about it. Worst still, his employer is taking a great liability risk for allowing him to continue driving their equipment.
Hopefully he goes to jail for a while and loses his CDL license. We don’t need druggies driving big trucks over the road.
Well first off all he can kiss his job good bye. Secondly he’s going to jail for up to one year. And lastly I don’t understand why he would have a scale if he wasn’t intending on selling.
The fact that he was driving a commercial vehicle is not going to help his case any.
