What if you are getting pulled over, and you eat the marijuana?

This guy I met at a party last night said that he was speeding and saw a cop from a distance turning his lights on, to pull him over.


He said that he reached into his pocket, pulled out a gram or so of marijuana, and just swallowed it quickly.

The officer smelt marijuana and searched the car, but did not find anything besides a baggie, which obviously smelt like marijuana and likely had marijuana in it previously.

He didn't get arrested or anything.

I thought this guy was really lucky. Couldn't he have gotten a DUI, or could they have done anything about the baggie, although there was no weed in it?

Just wondering.

    The guy was either very lucky or lying. The officer could certainly use the baggie as evidence of possession, it would have contained seeds and residue.

    He could also have been charged with a DUI if your state allows that. The smell is sufficient for the officer to administer a roadside sobriety test.

    Lastly, the guy is lucky he didn’t puke…..

    That sounds a little weird to me because police officers have new flash lights that when shined in the mouth they can detect marijuana.

    Yes the could have taken him in for a blood test and charged him with a crime. In Michigan it is a DUIN, (driving under the influence of narcotics) The cop just was not really interested in pursuing the matter, but the right cop could have arrested him.

    if there was residue (which there probably was), they certainly could have cited him for possession. the demarc between simple possession and intent to distribute would depend on the state or country where this occurred. you were both very lucky that 1. he got away 2. he got a cop that wasn’t interested in busting him for the weed. i hope that that was your last car ride with this guy and that this serves as a lesson to you.

    no evidence to be arrested for. only if they find drugs or paraphenlia can they arrest you. if they arrested him and really wanted to push it they could have done a blood test or urine to prove he had drugs in his system. breatalizer tests are only for alcohol which is usually dui is meant for. if all crazy fucked up i guess they could test and charge for drugs if alchol is negative

    You can go from having a misdemeanor possession of marijuana charge to DUI and destruction of evidence.
