Trying to gather information about a DUI?

Got pulled over a while back and have to appear in court on the 29th of this month. I never realized you have to go thru so much for a DUI definitely learned my lesson. I was under the influence and had an alcohol level of .09 and .08. At first i was thinking about going wit a lawyer but i dnt have ...





Got pulled over a while back and have to appear in court on the 29th of this month. I never realized you have to go thru so much for a DUI definitely learned my lesson. I was under the influence and had an alcohol level of .09 and .08. At first i was thinking about going wit a lawyer but i dnt have the money since go to school and so forth. I also had possession of small amount of marijuana in the trunk of the car which happened to be my friends but i dnt believe it was a mandatory search for the officers to search so deep in my car for a DUI arrest. What im trying to say is that lawyers have told me they will try to get a wet wreck less and the marijuana dropped but dnt have the money especially if i were to go to trial. Any advice if i choose to go with a public defender

    You will not get a public defender for such a case. You either get a lawyer (costs money but it will help keeping you out of jail and will help lessening the other penalties), or you represent yourself.

    You’re entitled to a public defender IF the max penatly for DUI in your state is 6 months or more in jail…It would be up to the public defender (if appointed one) to negoiate what charges stick and which have the potential to be reduced or dropped..

    Warrantless searches of a trunk are permissible in some circumstances. Possession is possession, even if you dispute ownership.

    If I were you, I’d find an attorney who takes credit cards. I don’t see this being a particularly expensive case. You can’t get a PD for a DUI charge.

    If you decide to go it alone, forget everything you’ve seen on television and try not to rely on advice from message boards. Get a book on municipal court practice, read up on the applicable statutes, and read the cases associated with them. You can do all this at a law school’s library.
