Yes it is. The weed alone is illegal then you drove high so yes that is a DUI. The other poster is WRONG there is to a test for that it is called a field sobriety test that is where the pen test comes into play.
There is no test for it. A pen test will never hold up in court. Just make sure and eat the roach. You will succeed if you can hold your weed. It’s easy to do. As the years pass on, you will be more tolerant of it and you will find that you can pass anyplace as straight, even if you’re stoned as cake. Your eyes will be red, though. And you do have to worry about the smell on your fingers, clothes and in your mouth. So keep some spray for your fingers and clothes and keep some toothpaste for your breath. And, for me remember, flip those cops off after they’ve left and go home and get some more weed and hit the road. P.S. don’t ever smoke when there’s cars behind you and you don’t know if they’re police. When in doubt, put it out and get ready to eat it.

And yeah, DUI’s cover all types of substances abuse, its Driving Under the Influence, of what it does not say. Even if they can’t use a breathalyser to check if you have pot in your body, if you’re acting sufficiently high, they can take you to a place where they CAN check for that.
Yes technically it is illegal but, I think that if you just keep it cool and don’t have any on you while your driving you will be just fine. Enjoy!!!!
