I'm on informal probation (no probation officer) for an alcohol DUI. I have less than a year remaining. I was just pulled over and the officer found that I had a "suspended license." The reason for this was that I changed insurances and my new insurance agency hadn't informed the DMV yet. This caused it to come up suspended because in order to drive in California, you must be insured. Also, I got a ticket for possession of marijuana that was an eighth or less. I have a court date next month. I'd love to know what to do in the mean time and what I could expect in court. I've already cleared up the insurance stuff...
The judge could order that you go to jail for the remainder of your probation time.
The reason they feel this way is that they put you on probation ……….. meaning you must not break any more laws and keep your record clean……….Unless it was medical marijuana with a Dr.’s prescription to go along with it……….it is proving to the judge that you don’t want to be a member of regular society……..that you prefer to break the law then to obey the law…..so to the slammer you will go.
I know of people who have the same problem of constantly breaking the law and then they are incarcerated for the rest of their probation period.
You could ask for a jury trial…..if you can’t afford a lawyer and you qualify then the court will give you a free lawyer…..or then just represent yourself.

wow..your pretty much in trouble. Um…well first things firsts…I would call an attorney and just tell them what the deal is. Maybe they have advice for you. It doesnt cost anything for a consultation. Hmm…thats funny you came up with a suspended license and didnt get taken in to jail…My fiancee just got pulled over and didnt know he had a suspended licenses for a stupid ticket and he is sitting in jail right now….must be a texas thing lol. good luck dude
You will have a pineapple shoved up there for every day for the rest of your life. Nah, but you could face up to thirty years in prison for posession of illegal substances.
I would attend some drug counceling classes. Try to do something that is free or cheap. If you use insurence you could have a hard time later getting approved for insurence later because they will considder drug addicition a health risk. In California I would guess house arrest.
In most states you can call the court and ask the maximum and minimum posibilities. My guess would be that a lawyer not a public defender would be a very important factor here.
My guess is that you violated your informal probation with the court and you may end up doing some jail time. While you can explain the insurance situation alright there is no way that your going to be able to explain away the drug charge. Even if its marijuana. I’d say that you put your self into quite a situation.
Courts frown upon people that are on any type of probation getting into further trouble with the law. You have really placed your self into quite a situation to say the least.
Get your self a good lawyer since you are going to need one with this. When you go to court make sure that you also bring your insurance stuff with you since the Judge may want to see for him self that, that has been cleared up.
Maybe if your lucky the Judge will give you supervised probation, so that you will have to report to a probation Officer. And maybe he will also request that you take drug classes. That would be better than going to jail.
