I recieved a DUI, I have questions?

I recieved a DUI a few weeks ago, still waiting for the court to send me a court date. I was driving drunk and high, the girl I was with had to take a piss... pulled into burger king.. she went behind the dumpster... I had pulled next to an undercover cop.. cop got out, long story short I took a sob...





I recieved a DUI a few weeks ago, still waiting for the court to send me a court date. I was driving drunk and high, the girl I was with had to take a piss... pulled into burger king.. she went behind the dumpster... I had pulled next to an undercover cop.. cop got out, long story short I took a sobriety test... stayed the night in jail.

Whats bound to happen to me.. the only thing I'm really concerned about is jail time. Based on the cirumstances, did the cop have the right to do what he did? How much for a first DUI... DUI with possession of marijuana. Should I get an attorney? Whats probation like... how can I pass these urine tests that they may make me take.

I'm 18 years old.

Also, it would be a lot of help if you could give me some additional information about stuff pertaining to this situation.

    I got a DUI a few years ago and if your sentencing is anything like mine, this is what will happen:

    You’ll get about 24-48 hours of ommunity service
    You’re gonna have to pay quite a bit in fines. When all was said and done, I ended up paying close to $3000.
    You may have to spend a bit of time in jail. I had to spend 4 days in a "work release" program, meaning you can continue to go to your job everyday, but must come back to jail as soon as you get off.
    You’re gonna have to go to alcohol classes. I had to complete 12 hours (12 classes). Many people also have to perform random UA tests.
    On a brighter note, it was my first DUI also, and because of this the DA was willing to give me this deal where the DUI would be erased from my record IF I completed all the community service, classes, etc. on time. I’m guessing they’ll probably give you this opportunity as well.
    Good luck with everything. I know things are probably pretty scary right now, but you’ll get through it.

    Yes get an attorney! They will know ways to get around some things if you can.
    I don’t know Florida laws. sorry
    In my state there is 3 days in jail, suspension of license, DUI class, and fines. But it is different if your under 2. Pot possesion here is minimal, fines w/o jail time unless you have over an ounce.

    You will be lucky to afford car insurance, expect to pay several hundreds per month. You will probably not get jail as you didn’t hurt anyone, especially if you agree to go to drug & alcohol classes. You will be on probation (lots of fun there!), where you will have to let your PO know where you are at all times and have him/her make unannounced visits to your home to see what you are up to. As for additional stuff, you MIGHT get out of this if you enlist in the military, but I doubt they would take you for the drug rap. Best advice – don’t run with the folks that got you into pot & booze any more, they will get into more trouble as they get older and be only too happy to take you with them.

    Yes. Get an attorney. You haven’t had a plea hearing? It should have taken place after a couple of days. Yes, it’s OK for a cop to check you out (taking a piss behind a dumpster is a clue).

    If you had possession, that’s a worse offense. Get an attorney ASAP. You’ll need it.

    Expect a big fine, some jail time, community service, drug rehab, license suspension of at least three months, probation of a least a year, and very high insurance premiums for at least three years.

    How do you pass a drug screen? Don’t do any while on probation. FYI…Most places do a hair sample test. You cannot hide from that.

    you usually don’t serve jail time for a first offense , but it would be a good idea to have an attorney or let the court appoint one. If you don’t know your court date, call the DA’s office or the clerk of court office. If you miss your court date, a warrant will be issued for your arrest.

    if you get probation – likely – your probation officer can make you take a urine test at any time and will most probably make you take a test on the first day so be prepared.

    if you fail your drug test, you will be in violation of probation and if you received a suspended sentence, it can be reinstated and your probation can be revoked.

    you really don’t want this on your record

    .Bad move. Listen, states are getting sick of scraping the remains of people off windshields who were killed or hurt in dui cases.

    Get a lawyer if you can afford it. Each case is different and Yahoo Answers isn’t the best place for this kind of legal advice. I would say you might be able to fight your DUI first offense yourself, but the pot makes it tricky.

    The cop was fully within his rights if you were visibly drunk while driving. And you were – you won’t be able to argue it. You won’t get the case thrown out that way unless you have a better lawyer then you can afford.

    For a first DUI, you are looking at a few thousand in fines and fees, 6-12 months of suspended or restricted license, 6-24 months probation, community service, manditory drug and alcohol screening, manditory classes, etc. That doesn’t count the doubled / tripled car insurance rates and other minor things that come up for years.

    With the possession, you might be looking at 30-90 days in jail in addition to everything above. Probation isn’t bad unless you get in trouble again, and it’s easy to pass a urine test – don’t smoke pot.

    As long as you have a clean record, talk to the prosecutor and see if he will drop the marijuana charges if you plea guilty to the DUI. The drug charges will really hurt you in the longrun. If he does, be respectful, apologetic, and take full responsibility for your actions in court. Wear a suit, and grin and bear your punishment.

    You are young and it will be over before long, just stay out of trouble in the meantime. It hurts once, it will ruin your life if you get caught again.

    Johnny, the cop was justified with the actions he had taken. The laws are particularly stern with underage offenders. Now the most important thing for you to do is to look out for a DUI attorney.
