I had just got off of work at 11 p.m. I was waiting for my boyfriend to come and pick me up from work like he always does. and I was getting pissed off because he was not showing up to come get me, so 30 mins passed, I was like this is NOT like him to do this to me AT ALL. so I keep trying to call him on his phone no answer at all. Then I find out that he was stopped because the officer said he had a DUI for Marijuana. My bf said that they basically stopped him because he fit the profile of a stoner. AND because he had a Bob Marley shirt on. Which is totally discrimination. The officer kept asking him "are you high" my bf kept saying NO im not!. then the officer said then why are your eyes bloodshot, and my bf said because I just woke!. My bf had worked 7a.m-2p.m he slept the entire time toill he came to pick me up. and the officer said if he doesnt admit that he is high then he will sit in jail until his court date which is in a month from now. my bf falsely admitted to being high ONLY because he did not want to lose his job. So at traffic court what can my bf and I expect? do you think we can win? what can we do to win? we cant afford an attorney so we are just going to go for a public defender. Should we bring in our schedule of that day to show the judge what time we both worked to show that we are not lying???
the officer also gave him a roadside test, and they said he was impaired but the WHOLE time the officer kept interrupted him purposely just so he can seem impaired. they also towed my bf's car.
they wanted to drug test him, but the officer was like if we drug test you and u come out positive your fucked (those were his EXACT words)
so my bf was like that is not fair, because I have SMOKED but I am not high right now, I just woke up. so what can we do? please help

To Gonzo: YES! thats exactly how it is. You know what I will stand by my boyfriend and fight this no matter how long it takes. Maybe they should test all those police officers and see how many of them come out positive for marijuana.
If he has a history of smoking and he gets tested, it’s probably going to show up and it won’t help his case. That crap can be laced with other drugs sometimes and he could have been relapsing, causing him to have the DUI.
Cops don’t accuse people for fun…it’s a pain in the ass to do the paperwork, the on scene testing, and then going to court over it. Most likely your bf lied to you about whether or not he smoked. But your only ray of hope is that your bf can tell the judge that the cop interrupted him while trying to do the sobriety tests—which will nullify the tests. Also, if the cop truly said that if he doesn’t confess, he’ll sit in jail until his court date, that is illegal–get a lawyer’s advice on that.
Keep in mind, he had to be doing something stupid to get pulled over–they can’t see your shirt through the window before they pull you over. He probably smelled like marijuana if he’s used to smoking it. I honestly think the cop probably found a little baggie or something to have said what he said….but neither of us was there. Good luck.

Honey run as far away as you can from this guy because the rest of your life will be on skid row if you keep this bf. If you have half a brain you will take my advice.

Fight it in court…. that’s all you can do.It will be his word against the officer. All three of the answers are correct, just sounds like you don’t want to hear about the last two (which are most likely more correct).
Sometimes it’s just easier to say the cops are crooked than to accept the truth.
Cops lie to get people to make false statements, basically tricking people into thinking they will be in less trouble if they admit to a crime.
He would not have been in jail for a month. In fact his statement is probably the only evidence against him, since you didn’t mention any possession charges, and they would have had to let him go. He should have told the officer to f*** off (i’m serious) and then called a DUI attorney.
In situations like this you can’t afford not to get a lawyer. If you really really can’t afford one then you should just keep your mouth shut, even if they do find a way to charge you, a public defender will have a lot more to work with if you don’t admit guilt.
Meet with your public defender and see if they will argue that the cop persuaded him to make a false statement. I wish you luck, although TBH it doesn’t sound good.
At his first appearance he can plead not guilty and then the court will set a trial date. At that trial he can defend the charges. I assume that he rushed right over to the hospital to arrange a blood test. If not, it will get a bit more difficult.
The funny thing is, you don’t have a CLUE what actually happened. You weren’t there. You are only getting your BF’s side of the story, which wouldn’t be slightly biased, now would it?
He can do what everyone else does… go to court. You, on the other hand, have nothing to do with this, all you can do is pay for his lawyer.
