Anytime someone takes a substance that changes how they feel driving becomes more risky. Just like any other drug (legal or illegal) that slows your reaction times or causes you to misjudge situations, driving with marijuana in your systems should still be ( and in some states is ) counted as a DUI.
it ought to be – the difficulty is finding a test that will accurately show if a person is driving under the influence. Most tests for marijuana simply indicate if the person has used it at all in the past days, or weeks.
I don’t think people should drive under the influence of any drug – legal or otherwise. Common sense should tell people that. And yeah, the law should be the same for driving under the influence of all drugs! Alcohol, marijuana, other – they all impair your normal abilities & judgements.
I would agree with the argument that marijuana impares your driving ability but stricter measurements of THC levels need to be established to determine level of handicap.
Just like there are breath tests to determine approximately how much alcohol was consumed, we need to establish a similar test when a person is suspected of being under the influence of marijuana. Right now no such tests exist, you either pass or fail.

you have the drving under the influence of OTHER – meaning anything from narcotics to prescription medicine to cough syrup.
They shouldnt be driving under the influence, but no, I dont think their license should be pulled just because they have an rx for marijuana. Please. People walk out of the doctors office on rx’ed narcotics that are far more narcotic than marijuana every day and no one brings this up.
Yes, marijuana is included in virtually every dui law. Some states have different versions. In some areas you can get a dui if you have an trace of any metabolite found by any drug test. Which is of course unfair since metabolites show up for weeks after use. Most areas have laws that require a blood test for official charges even for alcohol, and they also look for marijuana. Thc levels at more than 2ng/ml in most areas is a dui.
You can also be given a dui for having any other narcotic substance in your blood, including benedryal, any rx’ed narcotic, things like NyQuil, and so on.
However, it might comfort you to know… studies that compare the effects of thc to the effects of alcohol show that participants dosed with thc even at much higher blood levels perform better in on the road tests than those who have alcohol but are still under the legal driving limit.
