Cops, is it true you're only impaired for a DUI citation if you fail the breath/roadside tests?

This is a 2 or 3 part question. As a cop, if you suspect the driver is under the influence of marijuana but find no evidence, DUI can only be applicable if they fail the roadside test, which I'd imagine is next to impossible? 2nd part, if they have a med marijuana card, it expressly states you...

As a cop, if you suspect the driver is under the influence of marijuana but find no evidence, DUI can only be applicable if they fail the roadside test, which I'd imagine is next to impossible?

2nd part, if they have a med marijuana card, it expressly states you can't drive. What stops them from driving even if you do smell it? The given is an individual high on marijuana is going to be able to pass all roadside tests 99 times out of 100. and there's no additional testing for marijuana impairment?
So basically, I can smoke pot all I want while driving provided I can pass road side tests and there's no evidence other than smell, legally?
Contrary to popular belief, a individual on marijuana can still recite their alphabet, touch their noise, stand on one leg, all while eating a cheesesteak and fries.

I know I'm a pot head thug, I'm a massive threat to society sitting on my couch spacing out eating chips.
Right but my glazed eyes aren't enough for you to charge/arrest me with anything.

    Yes, the first part of the question is true. You must show signs of an impairment for the officer to have probable cause for your arrest.

    The second part I disagree with. Marijuana alters your mind. If it did not, you wouldn’t smoke it. If it alters your mind, it alters your actions. These actions can be detected by a trained officer. My department has shown a dramatic increase in drugged driving arrests since our officers have received training on drugs that impair driving. And the bad news for driver, unlike alcohol that has a predetermined limit (.08), any amount of a controlled substance is illegal.

    The doctors must share the same opinion, or they wouldn’t caution you against driving.

    I’d say no, there are ways to find out if you have been smoking pot and are a pot head thug.

    Yes, here are a few signs of a Pot-head:

    1. Tattoos on arms of pot leafs
    2. Suspect seems dull and unresponsive
    3. Glassy eyes
    4. Stupid talk (what I call it) they sound ignorant/low IQ
    5. Smell in the air

    There are a few, now quit smoking that crap and grow up and be a real man for once in your life

    let’s put it this way, if a cop pulls you over and thinks you’re high, there’s nothing stopping him from arresting you and giving you a DUI. it will then be up to you to prove in court otherwise. dude, just make good decisions
