Charged with DUI for the first time in California?

My boyfriend was in Alemeda County (Ca.) & was under the influence (marijuana). He was pulled over &spent 12 hours in a holding cell. The Officer took his license but for some reason it was returned to him. What will (most likely) be the outcome? Probation (how long)? Fines (how much)? Suspe...





My boyfriend was in Alemeda County (Ca.) & was under the influence (marijuana). He was pulled over &spent 12 hours in a holding cell. The Officer took his license but for some reason it was returned to him. What will (most likely) be the outcome? Probation (how long)? Fines (how much)? Suspended license (how long)? Is it possible for him to get off with probation & community service?? Thaaaaank youuuuuuuu!!

    First, his license was likely returned because the police are waiting for the results of a blood test (breath test results are immediate, blood test go to the lab and take time.) Without the blood test results they would not be in position to immediately take the license (as they usually do.)

    When the results come back positive for Marijuana he will get an automatic 4 month suspension of his license from the DMV. Which will become a six month suspension upon a conviction for the DUI. He will be sent to DUI school for three months. He will be fined by the court for ~$1,444. Three years unsupervised probation. Depending on the judge he may get comunnity service in addition.

    Odds of getting probation and community service are low – He will either not get convicted of DUI (plea bargin or not guilty finding) or if he is he will get they penalties mentioned above.

    my friend lost his license for like a year, but he was caught DUI twice, so i don’t know hwat happens on your first offense but gl

Any aggravating factors, such as an accident, driving with a suspended license or a high blood alcohol content can significantly add to the penalties, as will a previous DUI conviction.

    Get a good lawyer, and go to court..
    don’t play a smart ass.. he will get deeper in trouble.
