can i be given a DUI for driving and being high on marijuana?

how does a cop determine if im high or not? a test? just from observation? what are the punishments?


also are there punishments for just being high in public?

    DUI means Driving Under the Influence…so yes, you can be given a ticket for it.
    Police can tell if a person is high by your body language, your words, the way you
    act and they can smell the pot on you.

    You can possibly lose your license, the car you are driving and maybe get jail time.

    Yes, its still a DUI. they can tell by your pupil’s, and a urine test. I assume its the same as a DUI for drinking, because they are the same things. Driving under the influence of a controlled substance.

    Get a purple card if you live in california its 200 bucks a year. and you can be high in public and carry weed on you. Just say you have insomnia and chronic back pain. works nearly anywhere.

    Yes you can, depending on your level of "highness." As long as the officer deems that you are too high to drive.

    You can be given a DUI for being under the influence of ANYTHING. Even perfecly legal prescription medication. Just because it’s legal for you to be taking something, does not mean that it’s legal to drive if it affects you. It’s pretty easy to figure out if someone is high. After that a blood test will confirm it. The punishments are identical for DUI on alcohol. You could get charged with public intoxication for being high just the same as for being drunk. What that entails depends upon the state. In some just being drunk/high isn’t enough. You have to be boisterous, in an indecent condition, passed out, etc. Some just being in public is enough. All depends on where you live. Both are misdemeanors so can have up to a $1,000 fine and up to 12 months in prison. Both would end up with a more severe punishment than the guy that was just on alcohol.

    Yes, you can be charged with DUI usually the cop will most likely smell the marijuana in the car or find some residue inside the vehicle. And you will have to go to DUI school license suspended etc as if you were drinking alcohol. Yes, there is punishment for being under the influence in public is called public intoxication which is a misdemeanor in most states. Hope this helps you out

    In NC, you can be charged with a dui if a drug test shows positive for the metabolites of marijuana – so, if you smoked last week, but still test positive for the metabolites tomarrow you can get a marijuana dui.

    And since marijauna is not legal in the US recreationally, that is how most states will do that…. if you test positive for marijuana or the metabolites.
