Can a California dump truck driver get a license for marijuana?
My friend got pulled over for dui but not drinking but they found alot of mary jane and now he wants his doctor to prescribe it so he wont get in trouble and he gonna say for migrains maybe the world biggest itiot? !

There is no such thing in California as a "license" for marijuana.
Doctors are not allowed to, and do not, write prescriptions for marijuana. They can recommend it, but they cannot and do not prescribe it.
You can be convicted of DUI in this state anytime you are driving under the inlfuence of drugs and those drugs impair your ability to operate a motor vehicle. It does not matter if it’s marijuana or Valium or Tylenol – if it impairs you, you can be convicted of DUI. So the doctor’s recommendation isn’t going to make any difference.

It is easy as pie to get a pot license in Cali. Just say that you tripped and fell and sprained your ankle back when you were in kindergarden and they will give you one. It is such a nice loop-hole. BTW, Venice Beach is great.

even if he had it prescribed it would be after the arrest so the original charge would still stand, and even if it were prescribed he wouldn’t be able to drive while under the influence
Marijuana’s still llegal if your doctor prescribes it, even if your state government says it’s legal, because it’s illegal in the national government (which ranks higher than the state government)…so, he’s prttymuch screwed

It doesn’t matter if he has a prescription or not. He’s still guilty of driving under the influence. And it’s really getting hard to have a doctor prescribe it anymore as the Federal Government is cracking down. It still violates Federal laws.

He needs a CDL to drive a dump truck… and you ain’t doing that with a possession conviction.
The medical Marijuana in California is an AFFIRMATIVE DEFENSE. That means in most areas (cept San Francisco and Berkeley) you still get arrested and charged and you must prove your disability. This includes having a doctor TESTIFY, and not many will. The DUI will still stand pot card or not as it is the impairment that matters and not what caused the impairment. One other point if your friend does get a pot card, make sure he keeps it a secret, if thugs find out you have a card, they assume you have bud and will target him and his home. It is occurring more and more often.
He can get a license for Marijuana, but he won’t keep his commercial license. It’s still a DUI even if it is prescribed.
He may be able to get it for the marijuana but wont need his CDL anymore. Wont have a use for it with a DUI. Either way he screwed himself. Best just to do his time and face the punishment than to waste the cash to fight it because he wont win.
