Got arrested for a dui. I blew .083 which is only .03 over. They were also under the impression that I was using marijuana. I was not using that day. I was given a urine test at the precinct. If that result comes back positive I will not be given a work permit to drive. I will probably fail that test. My question is that my arraignment will be 07/09, if I just plead guilty for the dui then do you think they will skip the drug test results so I will still be eligible for a work permit drivers license?
I live in Ga if that matters. Also I was pulled over for cutting through a parking lot where it was posted not too. I was not citated for that.
The officer told me the results will not be in for 5 months. Also it does matter iif you got citated alot of times when referring to motion of discovery this is to the guy who was saying im not smart. Obviously I have made a bad decision but I do not think all people who drink two drinks and drive are stupid. Happens to people all the time. Also in my eyes I do not think that use of marijuanna in your own home makes you a stupid or bad person either.

    No, they won’t. If the results are not back by then (they should be), the judge will delay any decision until he/she receive them.

    Okay. Couple of things. I don’t know what the laws are in your state, and they’re somewhat irrelevant now since you’ve already taken action.

    What you need more than anything is an attorney. not a public defender, but a hand-over-your-wallet lawyer, or plead not guilty and force their hand into a jury trial. You need someone on your side who knows the judicial process and (purportedly) will jealously defend the interests of his/her client.

    I’m serious about this. The other side will have a lawyer who will take pleasure in burying you.

    Get a lawyer, trust me on this.

    It doesn’t matter if you are .03 over or if you’re .30 over – you’re over the limit. It also doesn’t matter if the parking lot was posted or not, you can’t cut through any parking lot for a short cut. It doesn’t have to be posted at all and the fact that you weren’t "citated" isn’t important to anybody.

    Why were they "under the impression" that you were also smoking pot? That’s not something they would have the impression of unless there was a strong reason. The fact that it’s going to show up in your drug test speaks for itself.

    If you plead guilty for the DUI they will still use your drug test so you’re not getting out of it. You don’t sound like you’re smart enough to be trusted with a car anyway so consider it a blessing in disguise.

    EDIT: I apologize, you’re completely right. You’re obviously a very smart and responsible person. That’s why you’re looking at the possibility of losing your license. My mistake.

    Also, there’s no such word as "citated."

    First off, you didn’t have two drinks. If you were over teh limit, it wasn’t two. Every person who gets a DUI always claims "it was just two drinks" but that’s impossible.

    Second, whether you were .003 over or .100 over, you were still over. It’s a DUI.

    Third, they’re not going to drop the drug results simply because you plead guilty – like what? You’re going to fight it? With what?

    You idiots who live your life around pot never cease to amaze me. It’s the most important thing in your life. YOu will be losing your license for a good while and rightfully so. The rest of us will be safer on the road. Sadly, I think, judging by your lying here, we can all assume this won’t be the last time for you.
