A legal question about marijuana posession…?

I am in the car with my friend, I'm in the passenger seat and he is in driver, a cop searches the car and finds a little bag of weed under my seat. The drugs are not mine and I tell the officer that. My friend is not there because they took him away for DUI. I get arrested. I tell them to give me a drug test, but they don't. The drugs were not mine and I ended up getting a court date and a ticket for possession of marijuana. I payed my 100 dollar bail(10% of the 1,000) and was released, what can I do about this?

    Make an appeal with a lawyer. A good enough lawyer and a sympathetic judge might get you off the hook. Current law states that you however are in the wrong. Sorry but try to appeal it.

    Plead "no contest" surrender the $100 and move on.

    Or drag it through court where you face much harsh sentencing and where the arresting officer will testify that the drugs were found under the seat you were occupying and that it is reasonable to believe that you put them there.

    Pick better friends to drive with.

    Logically, if all they did was find something under your seat in your friends car, it’s hard to tie its ownership to you.

    It would be helpful if you have a clean record. If you’ve been in trouble for possession before, you may have a problem.

    Go a good lawyer, go to court, and it will likely be dismissed.

    you could have appealed the case im not sure if you still can coz u paid the fine but you should talk to a solicitor to see what your rights are and if you have a good case.

    Keep your court date, get a lawyer(Or duty council), explain to the Judge what happened, and if need be letters of reference from your pastor, school, coach, physician. Any type of character reference may help.
    If you’re clean and have the funds to do it, a drug screen on a hair sample would prove your case that you don’t use, and may even toss the simple possession charge.

    if your record is clean . then no lawyer needed . go there . plea not gultiy. about the 3rd time they will offer you adeal that plea guilty . no jail , lil fine and will be taken off your record after 1 year or so if no same or simelar .

    I know it sounds hopeless but, depending on the amount in the bag and how much the cops shared with the judge and the quality, you could be looking at probation….or be chosen official roller.

    Your best bet is to hire a good defense lawyer. The burden of proof is on the prosecution,in this country, and if they can’t prove that the bag was yours, then you have to be found not guilty! You may have to pop for a drug test, blood or hair, so if you are a user then just shut up about it pay the fine, serve the time and forget it!

    Cops are not mind readers. Maybe the drugs weren’t yours for personal use, but maybe you were buying for someone else. Whatever…….they were in your car. Sad but true.
    Maybe you need to think about the company you keep?

    Anyway, sounds like you need a lawyer.
