Will the insurance company cover damages caused with a second dui?

An idiot friend of mine just got into an accident on the freeway, caused road damage, totaled his car, and got his second dui. No other cars were involved. An idiot friend of mine just got into an accident on the freeway, caused road damage, totaled his car, and got his second dui. No other cars were involved. But his cousin was the passenger and sustained minor injuries during the crash. The driver has full coverage on the policy but this is his second dui in california. Will the insurance company cover damages to the road and hospital bills incurred by his cousin? ambulance, pain &suffering etc.. or are they shit out of luck because they were both under the influence? Could his cousin sue the insurance company? All answers are helpful, thanks for your time.

    It depends on what coverages your friend has on his policy. I am not familiar with CA insurance laws and coverages, but if he has medical payments on the policy, that should cover the hospital bills up to what is listed on the policy. Also, your friend with the DUI, was he driving on a suspended license? Cause if he was, that may cause some issues with the insurance company and if not, I would expect his insurance to cancel him since he was driving under the influence. As for the passenger, he cannot sue the insurance company but he can sue the driver of the vehicle for medical bills, pain and suffering, etc.
