Good question. Tricky too!! Most who read your post will stop and wonder the same thing. As far as the DUI is concerned, the driver, not the owner of the car, is going to be prosecuted as you know. Your brother needs to make sure that he gets a $ lawyer $ to represent him in this criminal case. The DUI charge is going to affect his ability to drive in the future. Depending on whether this is his first offense, he may be able to get into a program that results in a dismissal of the charges, as long as he completes certain alcohol education classes. Definitely, he needs to consult a lawyer.
As far as damage relating to YOUR insurance is concerned, you are the primary on any claim by another person. I’m assuming that there were no damages to property, but if the owner’s policy is not enough to cover the damages, if any, brother may be held responsible. Furthermore, if your policy covers the claim, the insurance company may sue him for what was paid out by your insurance company. I suggest consulting a lawyer here asap. The lawyer has a wealth of information that can benefit the both of you. Insurance on your car is not proof that your brother is personally insured.
