THis is in the East Bay and does anyone know what is a good website that will explain this. We keep finding websites that just explain DUI rules but nothing on the law for auto insurance.
Rules vary by state, and you didn’t say where you are. If you are in CA, yes, they can now look back 10 years for serious offenses. If you want to add your location, you’ll get a state specific answer.
But I can’t think of a reason the insurance would lie about such a thing. So I would guess they can.
There are a lot of new laws in effect now in CA. Read about them here: http://www.snopes.com/politics/traffic/california2008.asp
Yes – the law changed from 7 years to 10 years.
You should also be aware that it is possible to get your DUI expunged (meaning it won’t show up in the public record and your insurance company won’t know about it.) Expungement is possible after completion of probation (usually 3 years for a DUI.) The site http://www.duimc.com has some more details and samples of the legal expungement papers that need to be filed with the court.
