The insurance company WILL find out about it, and since driving under influence is against the law, the insurance company probably won’t pay for anything unless you get the DUI removed, and only an attorney is going to be able to get close to that. They don’t have to pay if you were breaking the law, and these days, they won’t. They could cancel you or put you on high risk insurance.

I personally don’t see what they can do for you as you either had 2 very strong drinks within an hour or so of driving or you drank even more over time and then still get behind the wheel. That’s what 0.08 means, there is no way you just had 1 drink and waited an hour to drive home. The 0.08 at the scene and the 0.07 30 minutes to an hour later at the station mean that you were legally drunk when they pulled you over.
