I hope someone can help me with advise. I am legally separated from my looser ex. He always had terrible credit. So when his car broke, I had to take a loan on my name to get him a car. So the loan and the car is on my name. He was making payments when we were married. According to our separation agreement, he gets to keep this car as long as he is making payments. So far, he has not payed me for a month and it soon will be 2 months that he has not paid. On top of it, I just learned that he got a DUI and two tickets along with it (speeding and failure to stop at the stop sign). The car and insurance is on my name and he is just added to my insurance. Will the insurance drop me now, even if its him who got DUI? Will they increase my premiums? I am so scared, I have children, he is not paying me anyting and if now insurance drops me, I dont know what I will do. He can't get a loan because his credit is bad, he is not giving me back the car so that I can sell it, the car is on my name so whatever this looser does, I am responsible for
Has anyone been in this situation? Thank you for any input.
What do I do if he is not giving me back my car? Do I call the cops?
1. The car is in your name and he now violated the terms of your divorce agreement so first call your local police department and tell them what has happened and they will assist you in picking up your vehicle, you will need to bring the paperwork for the car and the divorce along with a friend to drive the vehicle back to your home …
2. When you get the vehicle back remove his name completely off the insurance policy and this will not affect you at all..
Kick him off your insurance.
Problem solved.
Call the police and report the car stolen, if it’s legally in your name then it’s no problem. Especially if you have proof he hasn’t paid you for it.
If you keep him on your insurance cost is going to skyrocket.
I’ve seen this before when courts require one spouse to continue with the transportation for the other spouse, and yes, even requiring the reg and insurance stay in the original spouses name. i don’t agree with it but it happens.
But now, you have a legitimate reason to toss him off your insurance, one that no judge will deny. Go to the court to modify the spousal agreement and get him off your insurance, and you should be ok.
