These mistakes are made by dui lawyers for three main reasons.
- Many dui lawyers are too young and inexperienced to know the law and have the necessary skills to effectively represent a defendant. Many times the young attorneys fresh out of law school will immediately begin representing defendants by taking appointments from the public defender's office.
The unfortunate people who cannot afford to hire their own dui attorney and get stuck with a new lawyer pay a steep price. While these attorneys are not given the most difficult cases such as sexual assault and murder cases, even the most basic disorderly conduct case can have difficult fact patterns and complex legal situations to work through. And DUI cases are unfortunately considered aeasya cases by too many in the justice system. So these young and inexperienced attorneys will be assigned to dui cases even though these cases can be very complex. These attorneys often get rolled by the prosecution, since they lack trial skills and the confidence to play hardball with the prosecutor.
Yet, even attorneys that have more years of experience often lack the skills needed to win. They simply have not put the time in to learn the law or the skills necessary to properly defend their clients.
- Many experienced California DUI attorneys have an inappropriate caseload by taking on either too many criminal cases or too few criminal cases. Some attorneys will take each and every case they can get from the public defender's office and any case that walks in the door. By doing this, they simply do not have the time that is required to handle the case effectively. Their performance in each case will be less than it should be.
Other California DUI attorneys practice criminal and dui law but only as a small percentage of their overall caseload. You may have an attorney with twenty years of experience. But will that really matter if 90% of his caseload is in the area of divorce law. This attorney will have years of experience, but not the experience you need. It is highly unlikely that they will know the law pertaining to your case as well as they should. Nor is it likely that they will they have the criminal trial experience that is required for a criminal case.
- Unfortunately many California DUI attorneys are just too lazy or just don't care. Attorneys are notorious for waiting until the last minute to file motions and to meet other deadlines in a case. They will do just enough to get by. They will never do more than the bare minimum on a case. They have seen hundreds of cases and know how a case will be resolved just upon reading the report. There is no reason to suspect anything other than the typical plea bargain. And that is exactly what they get. They are a prosecutor's best friend, because they make his job so easy. The prosecutor can get more of what he wants because he knows this defense attorney is just too lazy to fight.

I see advertisements for attorneys who specialize in getting people off DUI arrests. I’m pretty sure most police are not randomly giving out DUIs, there’s usually a good reason to get these drunk drivers off the road…but if they end up getting off because of a technicality even though they did drink and drive, how is this good for us?

This may not be what you want to hear, but I think that it’s a story worth reading and I hope that it helps:
I am an attorney and prosecuted exclusively DUIs at the beginning of my career.
95% of the time, most people just pled “no contest”, which is the same as pleading guilty. Most of the time, the defense attorneys would advise their client to plead no contest because it would be pointless to take the matter to trial (because the evidence was so overwhelming) and they could get a better plea deal by pleading early. The defense attorney often did their client (and the tax payers) a service by encouraging them to plead no contest early on. From our perspective, there was nothing more aggrevating, time consuming, and wasteful than taking a defendant to trial who represented himself.
So I liked a lot of the criminal defense attorneys, and I thought that they were helpful at least some of the time.
That said, you should also think about the situations where the defendant in a DUI case is actually innocent. I had more than one case where I prosecuted someone but had doubts about their guilt.
I actually had one case where I was relieved that the jury found the guy not guilty since, by the end of the trial, I was convinced that the guy had been wrongly accused. Basically, the defense attorney in that one was successfully able to show that the arresting officer confused who the driver was… we had effectively prosecuted someone for being the designated driver. Fortunately in his case, the system worked.
So how did the defense attorney in that case sleep at night? Just fine. She did her job, I did mine, the jurors did theirs, the judge did his, the cop told the truth and did his, the system worked, and everyone slept that night. The people who should have trouble sleeping at night are the people who are too lazy, dishonest, corrupt, or blind to do their job within the justice system–that’s when innocent people go to jail and criminals walk free.
Get a lawyer. If it is at all possible to not get that on your record it will save you lots of $$$ in the future.
I recommend that you interview several attorneys who specialize in the defense of DUI

How many cases has he defended recently. What was the outcome of those cases.
Also a good interview question is to ask the attorney if you were not available to defend me, please give me the names of three attorneys that you respect and would recommend that I contact to ask them to defend me.
After you have done this you will have a very good idea fo what your prospects are and who the best attorneys are.
You will know much better who the good DUI attorneys are in your area than anyone here on this web site.
I do recommend that you hire a good attorney with a substantial amount of recent successful experience in the Defense of DUI.
One thing to keep in mind is that Blood Alcohol levels as measured by the Police are often 50% higher than the true Blood Alcohol level when measured by a reputable Medical Laboratory.
However it takes a very good and experienced attorney to make that defense successfully for you.
That alone often means the difference between a conviction and an acquittal.
The consequences of a DUI conviction are devastating. It is very important that you hire the best attorney that you can find.
