El Cajon, California Man to Face Trial for Drunk Driving Accident
Author: Robert Reeves
An El Cajon, California man will stand trial in a drunk driving accident case that occurred in July of this year. 35-year-old Shannon Shimp is charged with two counts each of murder, as well as gross vehicular manslaughter in the deaths of Ian Kinney and Joseph Warren Edwards.
The accident took place on Highway 78 on July 22nd. 19-year-old Tessa Medearis was in a Lexus with her boyfriend, 19-year-old Ian Kinney. A pickup driven by Shimp attempting to pass three vehicles skidded out of control, and into the westbound lanes. It crashed into the Lexus, which was also westbound, ending up on top of the car. Ian was killed instantly. Also killed was Shimp's passenger, 58-year-old Joseph Warren Edwards. Both men died at the scene. Ian left behind his parents, while Edwards is survived by his wife.
Tessa suffered moderate injuries, and had to be extricated from the wreckage. After the accident, Shimp, who had suffered injuries in the car accident, was taken to the hospital for treatment of his injuries, and then arrested on suspicion of driving under the influence. He was found to have been driving with a blood alcohol level of 0.19 when tests were conducted two hours after the car accident.
On Wednesday, Tessa appeared in court to testify about the car accident that killed her boyfriend. The Superior Court Judge ruled that there were grounds for a trial. There will be a hearing on December 3rd to decide on a date for the trial.
For the two families that lost the most in this tragedy, it seems like justice gets nearer every day. They have had to face the pain of losing their loved ones though no fault of their own.
California has a multi-pronged approach to dealing with the DUI menace. Not only does it have some of the most severe drunk driving laws in the country, but it has also had a significant amount of success in bringing down accident rates in the state, through better awareness programs for motorists, stronger checks and monitoring of drivers, as well as graduated licensing programs for teens that encourage them to be fully educated before they are allowed to drive on their own. The stringency of these laws has led to criticism from groups who believe that license suspensions and the focus on passing breath tests, are unfair. When we continue to have drivers like Shimp who think nothing of tanking up with alcohol that's more than twice over the legal limit, it's clear that these criticisms are baseless.
drunk driving..?
I believe that people should not drink and drive… jus recently a student from my school died in a drunk driving accident. A few years ago i thought that i couldn’t do anything.. that kids had no control over something like this, an that we could do nuttin to prevent it. However, i decided that enough is enough. We teens can do something about this an i want to. However i can’t seem to find a program about drunk driver for me to join in West Warwick, RI. I am sixteen by the wayy. An i know this may sound crazy but i am DEATHLY afraid of car accidents.. The site of a recked up car makes me sick, an i hav nitemares.. but i am willing to deal with those symptoms if i can do anything to help decrease the death rate in drunk driving. So if anybody knows any programs for sixteen year olds in west warwick, RI i would appreciate it.
try S.A.D.D (Students Against Drunk Driving) s.a.d.d.org
if there is not one in your area, this will give you the information you need to help you start one.
I’m proud of you for wanting to make a stand. Don’t live in fear, put your trust in Jesus Christ and Good luck getting this off the ground!
Drunk driving?
I thought it would be wise to ride my bike to the pub instead of driving. I got busted for drink driving because a bike is a vehicle. Is this law ( in Australia ) the same in any other places?
Drunk Driving?
I really want to no I dont believe that drunk driving or that drinking beer and stuff at all is good. What do you think?
soory i wanted to say;I really want to know what you think
Well i dont know but here in Michigan my friend got arrested for driving with under the influence for driving his electric wheelchair while drunk.
Confiscate the car on first offense.
I don’t mean IMPOUND (which gets returned). If the driver is afraid of losing their nice new car, they would think twice before planning to go drinking.
And if they didn’t think and drove drunk, that would be the last mistake because they would NOT have a car to do it in again.
Good Luck…
They should not be allowed to drive when they had too much to drink in the first place. If they go to a bar where they are known, hopefully they have some friends there.. and one of them will grab the key from them and either drive them home or call them a cab..and not let them drive or if they come as a group, they should be mature enough to have one designated driver who won’t drink.. who will drive the others back home that way a lot of senseless deaths could be prevented. Once a person is drunk, they can’t make rational decisions, if they go out and drive under the influence and someone gets killed then it’s manslaughter but it’s not cold blooded murder as this was not planned. A drunk driver is like an explosive device that is ticking.. it could go off any time. If it doesn’t it’s more luck than anything else.. plus the drunk driver also risks getting killed himself or herself or if he or she has passengers in the car who can’t drive, and all get killed, he has them on his or her concience also. If someone is found driving under the influence.. their driving license should be taken from them for a year. Maybe that will make them stop and think the next time. It can’t be seen as murder, it has to be treated as manslaugher considering the fact that some people get away with killing a person on purpose.. and only get 6 years imprisonment for willful murder, so killing whilst under the influence I hope if they survive and kill someone else whilst drunk, that this will trouble their sleep for many years and they will have nightmares and feelings of guilt.. rather than the punishment they receive from the law.. apart from losing their driving license..
How to decrease drunk driving – with underage people?
Hello, I am currently working on a speech that I will be giving relatively soon. I am looking for feasible ideas and suggestions of how to decrease drunk driving.
Some that I have come up with so far:
1) Increase awareness, educate and have commercials on the tv.
2) Make it mandatory for first time offenders to take a class, 2nd time offenders face more serious legal issues.
3) Increase the number of checkpoints within an area, this will discourage offenders from trying to drive, and if they are driving, the checkpoints have a higher chance of catching them before serious damage is done.
Much appreciated.
How do you think drunk driving effects people?
I’m doing a research paper on this topic and I need a few opinions on drunk driving and how people should be charged with killing someone while drunk just those kinds of things. I personally do not believe in accidents.
I think that drinking beer is good, and I think that drunk driving is bad.
