What is the penalty for a DUI citation? Not an actual DUI?

    A citation is the same thing as an arrest. This is a misdemeanor and citations can be issued for misdemeanors. It depends on the state and the BAC. Most states have certain mandatory sentencing guidelines based on the BAC. Other factors such as criminal history and "gainful" employment can determine the punishment.

    A DUI Citation IS an actual DUI. The first conviction is a Misdemeanor punishable by up to a year in jail and or a fine – or anything in between depending on a lot of factors.

    Is there a difference? No penalty unless you are convicted.

    Depends on what state you live in and what the laws are for DUI citations.
