


Woud a DUI offense be required to list on a job application?

They cannot hire anyone with a misdemeanor until 2 years after conviction. Its been over 2 years since my DWI which was reduced to "driving after illegally consuming alcohol" (given to persons under 21) which is also a misdemeanor.
They do a background check and are going to find this out anyways , so my questions are:
1. Do I have to write this down on the application?
The application asks you to "specify criminal charges. For all other answers, fill in the disposition/comments section"
2. I dont know if its considered a traffic or criminal violation?
3. I am afraid they will not hire me, I previously applied 1 year ago and they told me after I got the job that b/c the background had a misdemeanor I have to wait 2 years. Ive waited but I am nervous they wont want me anymore. Does this mean I have to pay for this every single time I apply for a job (i know i did something wrong but Ive learned and I dont want to still be paying for this 10 years from now)

If they are going to do a background check anyway, check "yes" under convictions and include an explanation.
At my company, if you come clean on the application it isn’t held against you if it is not job related. A DWI at my company, unless your job involves driving, usually does not have any bearing on employment.
List it as best you can; they will drop you for lying faster than for telling the bad truth about something
I think you should list the charges and the dates you were charged. chances are they will ignore them. First check with law enforcement if the violations are still on your record. If not just not mention it.
1. Yes, absolutely. They may find out about it afterwards and then you may be fired for lying on your form. Obviously, this won’t be useful for future references either…
2. I would call it a criminal violation – although I’m not certain.
3. If they were aware of your violation and told you to apply again, then I’m quite sure they will not hold it against you. You said you got the job and then they informed you you would have to wait – so I think you’ve as good as got the job now anyway. They wanted you before, so they will again. The fact that you’ve reapplied there shows determination, ambition, persistance and a real desire to work in this particular place, which are all good qualities. Good luck!
