Most state would consider you as a first time DUI, they figure it by the number of dui’s in 5 years. However, it your state does not most have a sentence up to 1 year in prison and/or a 5000 dollar fine.
In California I think it’s a year.

Wow I have never met anyone who has had TWO Dui’s. Usually they learn their lesson after the first.

I know someone who received 30 days, but it depends what county. You may get out earlier due to overcrowding.

also you will have to go to school and pay at least 14,000 thousand dollars to finish the program….

My Parents were killed in a headon with a drunk, when I was 4 years old…..
It may differ from state to state, but in California after 7 years your record should be cleansed of the first DUI. So you should only have to worry about your current one, and will avoid jail time. Dont be too happy though the current fee’s are going to cost you in the thousands. I know you will pay atleast $2,500, and I spoke with someone who said they had to pay around $5,000, but that person is an idiot and I wouldnt trust the figure.

What do you have to do, kill someone before you learn something? However long it is, it won’t be long enough!
At most you will get 30 days, plus the fines and what not. However it will help if you attend some AA meetings before your trial. That would help the judge see that you are making a difference and could help you get no jail time.
However if this is you 2nd DUI you may want to consider the fact that you may have a problem with drinking. Not to judge you, but I finally realized I had a problem right after my 2nd DUI, been sober ever since.
