100% some jail in most if not all states.
There is a 75% chance you will spend at least 15 days in jail. However, if you show you are gainfully employed, you may be able to negotiate with the DA on weekends in jail or even an ankle bracelet house arrest instead of jail. This would be conditional of you not having any other items on your record in addition to the DUI’s.
Depend on the state. In New York where I am from if you get charged with an alcohol involved driving twice within two years it is a felony. Now there are some factors that come into play. What county has the case, are you affluent or poor. In New York City they want to save jail space for hard core criminal so a DWI Felony might walk after paying a huge fine but in a rural county such as the counties between Utica and Syracuse you might see 6 months to a year in jail. Now if you are rich and can afford the right lawyer chances are pretty good you might not see jail at all unless in the process an innocent person was injured or killed.
In my state, if they are 7 years apart, it is treated as a second offense. The minimum term is 10 days. The maximum is 5 months and the usual is about 20 days. The next state over is different. There is not a judge in the world that will completely ignore a prior conviction for the same offense, no matter how old it is.
