2nd DUI offense. What is the best way of proceeding. What are my probable penalties?

I'm in dire need. This was just bad luck. I got cited in Oakland and my court date is on April 10, 2007. What is the best way for me to proceed. If anything I want to avoid any jail time. And please, no smart remarks...i'm down, so no need to kick me further. Any help is appreciated. ...

Hmmm. I suggest joining a volunteer group and becoming a mentor asap.

You could also start attending AA meetings. You could dry out AND get good advice from the other members about your situation . . .

Best way to proceed is call a lawyer.

LET ME GIVE YOU SOME GOOD ADVICE, DUI’s don’t just happen to unlucky people……………DONT DRINK AND DRIVE!

Get an attorney. you’ll save money, time, effort, headaches, and maybe even some reduction of penalties, fees, or charges. Without one, on your second offense, you’d be a sucker at the mercy of an unmerciful court. Get the best you can possibly afford. It’ll more than make up for it later.

Also, quit drinking! And I mean cold turkey! Join AA before the court date. This will sound better to the judge.

First thing find a reputable attorney, and follow their instructions, was sentenced to 90 days for a 2nd, and did 45 before being sent home on a "phone tether" for the next 45…may have worked out better for me at the time if I had not still been in my probationary period at the job I working then. I’ve seen many get work-release, where they just sleep in jail, but get out everyday to go to their job….good luck!
