What will it take to strengthen our dui laws?

A friend of mine was seriously injured and her boyfriend was killed by a drunk driver a couple years ago. The drunk driver had 2 previos dui's and he walked off with 5 years probation and 10 year loss of license. It would have been nice if he was sentenced to prison time. How come he wasn't? FYI the sentencing was just today and this happened 1 1/2 years ago.

    It depends what state you’re in and the circumstances. Probation or house arrest is typical for DUI deaths. Lawmakers in MASS are trying to move harsher penalties forward. All this following 5 DUI crashes involving MASS state troopers in just one month. When someone of importance dies the laws will change. Until then hundreds of Joe Averages must die each day until then.

    Nothing. The laws are already harsh, it’s just that people are still violating the law in greater numbers. Putting the penalty at life in prison won’t change the number much.

    What should happen is a greater emphasis on education in schools regarding driving while intoxicated. Also, many people don’t trust the police, and so ignore what the public perceives as "their rules". Lastly, the legal intoxication BAC is arbitrarily low. In many states, the limit is set at 0.08, which is slightly over one alcoholic drink for the average person in an hour. Not many people are really impaired at that level.

    Because of this, many people have a drink or two and ignore the laws because they are too strict for no reason. People should be arrested based on their actions and not an arbitrary number.

    I’m sorry about your friend and her boyfriend, but more and more laws will not do a thing to stop those types of deaths.

    I don’t know why he wasn’t imprisoned. I know someone who was sentenced to 45 days in jail and a year’s probation/license revocation for a second DUI (within a two year period)…and no accident/death resulted…in Michigan. They need to crack down in whatever state you’re in…that’s ridiculous, and tragic.

    Well i can tell you that it was not in Illinois! The laws due to public opinion have been getting tougher!

    Now, there are one of two reasons the guy got off light. First is a GREAT attorney. The second is some extenuating circumstances that you are leaving out in your details…????
