Decades ago, the term used across the nation was "DWI", Driving While Intoxicated.
Over the years…. most every state has gone to DUI "Driving Under the Influence".
The reasons are as follows:
1. You can be considered under the influence even if your Blood Alcohol Concentration (BAC) is not over the legal limit.
2, To take into account people driving under the influence of narcotics, recreational drugs or even prescription drugs.
It was a name and statue change to up date the laws to accommodate a changing time.
The charge in most states is "Driving Under the Influence", or
DUI. It has replaced the old DWI (Driving While Intoxicated),
I believe, so as to cover driving while on drugs, prescription or illegal. Or over-the-counter, for that matter.
You might do a search for your state’s State Code. It should have the statute in it.

dwi means driving while intoxicatated which means if your drunk you usually get a dwi instead of a dui
In Illinois, the actual term is Driving Under the Influence (can be either alcohol or drugs or both).
After the blood alcohol test, an additional charge of Driving with a BAC over 0.08% is added.
The old term of Driving While Intoxicated did not cover all situations, and left the interpretation of "intoxicated" rather vague.
DUI-driving under the influence (not over the legal limit but your driving in a negligent or reckless way)
DWI-driving while intoxicated (over the legal limit)
Operating/driving/being in physical control of a motor vehicle while under the influence. Check the State traffic laws.
