    In Idaho it is .08 is the legal limit, if you are found to have a high BAL (blood alcohol level) you are arrested and charged with a Misdermeanor. You are not charged with a felony until you have three arrests in a 5 year timeline. Or if someone is injured.
    You can also be charged with DUI if you are found to be under the fluence of illegal drugs/prescription drugs

    California the limit is considered point zero eight (.08) and if you test over this you are guilty of DUI. You have a right to a breath, blood or urine test and you may choose. If you refuse to choose one of those tests they will almost always find you guilty unless you can show you were on some sort of medication.
